Not everyone gets banned for that speed on the motorway , police officer or not.

Depending on the circumstances at the time and the driver , magistrates sometimes don't give a ban and will instead give you points and a fine as happened here.

Ordinary members of the public can "get away" without a ban as well.

If anything this goes to show that other coppers won't turn a blind eye.

Oh , and someone I know was banned for 28 days for 103 on a motorway.

He was a class 1 advanced driver and had to do his assessed drives again as a result.

I'm an AFO (Authorised Firearms Officer) and protect Special Nuclear Materials. My duristiction extends 5km from my workplace or anywhere in the U.K or World with SNM materials being escorted. (Marine, Air, & Road). I am with the CNC (Civil Nuclear Constabulary) so I therefore don't make many arrests like the Home Office guys would. My rank is constable. I am in an extremely rare Police Force. (most people no nothing about us).

Ahh, not many of you UKAEC / CNC people around! I have an application form for CNC floating around somewhere that they sent to me a while back when they had the recent big recriutment campaign, even though I'm sure I never sent them my details! Spooky :P

Surely though, shouldn`t a policeman/woman be treated more harshly then the general public when caught braking the law since they are the ones paid to in force it in the first place on everyone else. As far as i am concerned if a policeman is caught doing 105 mph he should be banned instantly with a big fine and loose any chance of promotion for some time. After all i bet as soon as that policeman went back to work he was doing people for speeding so he should think himself lucky not to get thrown out of the force all together. The phrase " Do as i say and not as i do " springs to mind.

They install the safety equipment on them to stop the big cranes crashing into each other or into nuclear reactors or whatever :)

Well, they are in a way as they are often then disciplined in line with the Police Regulations, which can include fines or worse.

Assuming we are talking about a motorway , 96 is definitely not an automatic ban.

In fact people regularly get offered a fixed penalty notice for speeds like that.

For speeds like 103-106 on a motorway a 14 day ban is pretty common but by no means mandatory.

Well of 6 people I know of who have been banned not a single one was let of with 14 day ban!! All lost there license and had to re-sit there test.

So this would take approximately 4-6 weeks maybe more?

I would like to see you travel 2000+ miles a month via public transport, lugging around a computer and about 15-20 files!!!

A month out in my job could result in what ever projects im working on being delayed whether it is a hospital, police headquarters, schools etc... Which means we get hit by penalty clauses of up to 30K daily this would inevitably cost me my job.

I have to take the risk that when I speed that I may get caught and get banned this is a risk I accept. The same rules should apply to the police when they are off duty.

So in my opinion you are wrong!

I have been caught at some "silly speeds". I have been to court for some, I have been given a warning for others, I've had fixed penalty for the rest.

I've been stopped for an average of 138 on the M25 and given a warning

I've been stopped for 118 on a B road in Gloucestershire

I received a fixed penalty for averaging 98.6 on the M5, even though they said I was pulling away from them in places and they were doing over 140 :eek:

I got 6 points and £220 fine for doing 101 on the M40 as they said it would make me more aware of my speed if I could only get another 6 points in the folloowing 3 years

I had a fixed penalty for an avergae of 96 on the M4

So, it's swings and roundabouts. Magistartes guidlines say that, in theory, 95-100 is a discretionary ban and 100+ is a mandatory ban. This is sometimes waived, I know of a few who've been over the ton and given 6 or 9 points to keep them good for the next 3 years. I also know people banned for 95-100, usually only 2 weeks though with a £500 - £700 fine.

It all depends on the magistrates on the day.

As to the policeman being "let off". Cobblers. He was treated just like you or I, but he will have also had an internal reprimand or fine.

Unfortunately you aren't listening to what people are saying and you don't know what you're talking about, so it's not much use trying to have a sensible conversation :rolleyes:

I'll try and explain it once more; magistrates decide on the penalties. The magistrates will accept an 'exceptional hardship' claim in most cases rather than give a ban if it can be proven that you will suffer exceptional hardship through a ban that is not proportionate to the offence. Exceptionahl hardship isn't the same as 'inconvinience' however, so 'having to get the train to work' isn't an exceptional hardship, but 'having to get to clients who aren't within reach of public transport, whilst carrying very heavy equipment' might be.
