What if the vehicle colour on the ticket is wrong? A colleague got a ticket with all the correct details of his van apart from the colour, the ticket stated yellow even though it is a plain white.

He was going to contest to see what happens but paid the fine anyway as he didn't want to end up with a larger fine to pay if it didn't work.

Yes, they would have a good case for appeal - if one of the details isn't correct, it could be possible for the other details to be incorrect.

If it's contested I believe this should stop the progression of the PCN, but I don't know whether that varies from issuer to issuer (so would be worth checking when you submit the appeal).

I also recall that there is a time by which an appeal needs to be adjudicated and that it's usually quite a bit less than the discount period, so if you get an appeal in quickly then if it's rejected you still only have to pay the discounted amount.

Personally, I'm not a great fan of punishing people financially. Maybe if they just let your tyres down it would be a fair deterrent??? That was a joke but the more I think on it - it would probaly work pretty well!!! Whatever happened to those annoying stickers they used to put on your windows that took ages to pick off?

Plus, I tend to find wardens pick on certain types of cars to put ticket on first and do not do it systematically. Fair enough if thats the "odd individual" but on saying that, its not hard to imagine alot people would do that, and it seems unfair to misuse their "power" like that.

ANYONE who is parked illegally (ie breaking the law) is liable to be caught. It's a risk you take. So what does it matter if the traffic warden only picks on certain types of cars, certain people, or even just a certain street - they are ALL parked illegally and therefore know the risks. Same with speeding which people also whinge about when they're caught.

And how would you rather people were punished? Having their cars towed and crushed? No, hang on, we couldn't do that as it isn't fair! ;)

Cor blimey, did you know, we have a book called the Highway Code in this country, although not law as such, sticking to what is in there will generally mean you won't fall foul of the law :thumbup:

I drive a white van for my main job, always having to park up and do deliveries, never had a parking fine, never had a speeding fine either, its really not hard to stick within the law.

Another way to avoid a ticket - if you return to the car and the great unwashed oaf hasn't actually attached the ticket to yoru car yet, don't hang about pleading with them, just jump in your car and drive away. Charges issued by traffic wardens do not stand unless they attach it to your windscreen!

Thats simply incorrect - where is your evidence to prove this? In my case they certainly didn't send it to my house, despite the weasel who was about to issue it saying "your too late I can't cancel it now". A parking attendant must hand the penalty charge notice (PCN) to the driver or affix the PCN to the vehicle for it to be properly served (City of London) If you drive off before they attach it your haven't been issued with a PNC...the only exception to this is where you have prevented them from issuing a ticket through physical restraint, intimadation, probably includes running them over. I've often seen people return to their vehicles to start arguing with a PA as they issue a ticket, if they were just to drive away the ticket wouldn't stand. Not much help to the OP but hey...for future reference!

Just for info, approximately one third of councils have went through a DECRIMINALISATION process for parking restrictions and enforcement (under the Road Traffic Act 1991). If you are parked where / when you shouldn't be in one of these council areas you are NOT PARKED ILLEGALLY. However...you have broken 'the rules', and can expect a fine....whether fair or not is a different matter. You won't find information specific to this in the Highway Code, so no point looking there. Different councils can also have different rules, such as different coloured lines or sometimes no lines on the road. In some parts of Glasgow, they'll have a sign up as you enter an area of the city saying that you can only park in marked bays everywhere else is more or less covered by 'invisible yellow lines'. If you miss all the details of that sign due to watching whats going on with the road ahead your screwed!

the 91 Act is in use with most Councils but wait for the next one 2004 Act This allows Councils to issue tickets by CCTV

Well if I may comment on this as a traffic engineer who is sorting out decriminalisation of parking restrictions; the areas in Glasgow I imagine what are called "Controlled Zones". These are actually quite common in many towns and cities and simply have a blanket restriction covering an area. Usually it's a limited waiting restriction (Mon-Sat 8am-6pm for instance) but it should have either a line on the ground or a sign backing it up. I personally am not aware of any restrictions (other than pedestrainised zones) which don't require any form of repeated information. As a responsible driver you should be driving in a manner which enables you to read road signs and be fully aware of your surroundings . . . that includes Controlled Zone signs (which are usually pretty prominent actually!).

Incidentally, the decrim parking transformation is indeed making violating parking restrictions no longer a criminal offence . . . because where decrim hasn't taken place, only police officers and police-sourced traffic wardens can actually book people. I don't think many police forces have enough staff to keep up with the problem, hence decrim parking effectively just hands the task over to the council.

Finally, I really think it's very childish to try and dodge parking restrictions. They're not there to earn revenue, they're there for a very good reason, usually to ease congestion / prevent blocked streets etc. Whether the line is broken or not, you are still plainly aware of it and as such by parking there you are being an irresponsible driver as you are purposefully violating a restriction. I think you should pay the ticket!:thumbdwn:

your first Excuse "to buy a newspaper" you would of had no chance of getting out of paying, the 2nd excuse you were returning a heavy item to a shop would work as long as that was all you did, i.e. park up unload the item, carry it to the shop and walk back to the car and then park legally.

If loading and unloading is allowed then thats all you can do, as soon as you stop and browse items or ask about something else not related to where to put the item or have a cuppa tea of use the toilet then you have started parking illegally.

My current Job I have been taught the full law of parking and where it is allowed and not, so any other questions I can find out quite easily. :thumbup:

Thanks for your reply. In the first case, I didn't know it was only 3 mins allowed (no signage (except loading bay) and the helpline confirmed that other bays generally 15 mins in our locale but those were only 3 mins. Oh well, too late now. In the second case, I was in a proper bay (30 mins), just a foot over the edge at the back and done in 10 mins (not causing obstruction or whatever, just outside the lines and thus also the rules.)

The CCTV parking fine won't change much here fine-wise locally, since parking attendants have limited and dedicated areas so little will slip by; it will put the attendants out of a job though :(

So what's all this about overhanging a line - I always thought that as long as your wheels weren't on it, it was OK. If it were the case then technically you could get a ticket for parking on the footpath if your mirror overhung it.

My wheels were in the bay, but the boot was over double yellows. Sorry, it was the dy's that were the fault rather than being outside the bay.
