What is a police collision report & why is it used?

Most of you guys will know i had an accident on tuesday which was my fault where i pulled out on a junction on another car.

Me and the other party didnt want the police at the time but last night i has a phone call from the police saying they wanted to do a collision report and check my license and MOT because the person i pulled out on had visited the hospital with a "neck injury"

They told me that it was nothing to worry about but asked me if i accepted liability to which i said i am not commenting on that as its in the hands of my insurance and they are dealing with it.

Then they looked at my car and checked tax then said i wont probally hear anything else from them and off they went.

What was this done for as i felt like they were trying to get me for not driving without due care and attention.

Was it because she had a (so called) neck injury.

I think you'll find that tommorow morning you might also back a back injury of some kind?

If they can't prove whose fault it was you can just claim off each others insurance for injuries.

It's standard procedure in any accident where there is an injury. Don't worry about it, as said, you will almost certainly hear nothing more.

If you have a collision on a public road, then The Road Traffic Act sets down certain tasks that you are duty bound to carry out, or face prosecution.

If you are involved in a non-injury collision which causes damage to another vehicle, or property, then you must stop at the scene, and provide the other driver, or owner of damaged property with your name address and vehicle details.

If you are involved in a collision which causes injury to any other road user including passengers in your own car, then you must stop at the scene, provide the details listed above and also your insurance details as well. You must also report the collision to the police within 24 hours or as soon as is practicable.

Whiplash (or whipCash) often develops some time after the collision so the other driver was fulfilling his legal duty by reporting the matter to the police once he realised he was injured.

Once a collision has been reported, then the police are duty bound to investigate and ensure that no traffic offences have been committed. the main checks carried out are making sure documents are in order, and that serious lapses in concentration or dangerous driving were not to blame.

It's rare for police to prosecute for minor injury collisions where both parties' documents are all in order, it's usually left up to the ins co's to apportion blame and sort out payment for injury or damage.

Most comprehensive insurance policies come with legal cover these days anyway.

Having read your other post about the large damage to the Renault 19 and just a small dent to your Skoda, I would be talking the police about my suspicions of an insurance fraud by the Renault driver.

I have read (and seen a television programme) about criminals who buy an old car and deliberately crash their car (pre-damaged) into another vehicle. I know you said the accident was your fault but how come there is such a big difference in the damage between the two vehicles?

When cases like yours were investigated by the police, the other drivers and passengers (there are usually passengers with "injuries") were found to have been in many similar accidents and made insurance claims against the other drivers.

My wife's car was hit from behind whilst waiting at an off-ramp and the other driver even claimed whiplash injury as she was driving backwards!

If it was me I would be raising the possibility of fraud with the Police and my insurance company. Admitting liability makes it difficult so was it really your fault or could you be the target of a scam?

Seriously though i have managed to obtain a picture of the car that went into me and its damage is a lot worse than at the scene of the actual accident. I have now sent this by email to my insurance claims department with strong words of how i feel it was much less damage.

It apears they have battered the whole wing and bonnet with something and i have said to my insurance that if you look at the damage to my octy (small scrape on the bumper) then they or any assessor would realise that my car would of been more severly damaged.

Its a nightmare why would they make the damage worse? its a 14 year old r19 it was more than likley going to be wrote off anyway.

If I was you, I'd contact the police and tell them you think this is a big fraud and that you are a victim, not the other party.They can assess by looking at both cars whether the damage was done in the accident or not, (more than likely not), thus rendering their insurance claim as null and void.

They end up with a damaged car the insurance won't pay up on, get done for fraud and you end up feeling a whole lot more satisfied:)

Many dont, and chances are even slimmer if you use a comparison site - many leave this out!

For the extra £5 some charge for it, it's always worth it IMO, as it usually covers more than just motoring related.

As others have said, present the pic to the police, get a ref of the report, and forward to the insurance co.

Insurance co will throw out any claim, and along with police likely take this matter further against the ren 19 driver and hubby!

even if the police try to pursue against you, the most they will do is write a letter to you telling you this time no further action will be taken, but a note will be left on file and if a similar incident involving you takes place in the near future then the results could be different. i had this quite a few years when i ran a lorry up the backside of a car who deicded to brake and i didnt see the faulty lights. (cops right behind me too). dont admit or deny anything just answer each question "my insurer has asked for all questions etc to be refered to them to be dealt with and i have been instructed to make no comment"

I know i've posted in the other thread, but I'll say the same thing again.

Chill out and forget it.

The incident was in reality so minor, that despite the "whip-crash" allegation and the supposed damage to the TP's car, the Police are truly not going to be interested in pursuing it any further. (Despite our paranoia about about their attitude to drivers they really do have better things to do)

Forget the photo being sent to the Police. Although you have sent the photo to your Insurers as it was not taken at the time of the accident it is of no real use - your word against hers / theirs.

Incidentally, regarding the stories ref. multiple, repeat, fraudulent claims being made, Insurers are well aware of this and some time ago set up an internal recording database whereby this type of info. is now shared and normally all claimants are automatically checked against it.

Well i have just driven past the house of the third partys car as i had suspicions of more damage being done to it over the weekend...

and the bumpber has noww been ripped off on one side and the drivers side headlight & indicator look like its been smashed with a hammer!!!!:mad::mad:

I sent a pic to my insurance as i felt that more damage would be caused over the weekend :(

The insurance have a pic but not with the damage the car has now (bumper pulled off and head light and indicator smashed)

What a bloody joke! They dont know that i have sent a picture on friday showing a smashed wing but on this picture the bumper and headlights wernt smashed.

Some people!!! Will my inurance want to inspect the third partys car or will they just leave it for the other insurance co to sort out, sureley the other insurance company acting on behalf of the third party will send my company pictures?

after my recent accident i took photos and informed insurers that i have photos in case the third party try disputing anything, also got the road and the driver in the picture in she denied driving or wasnt insured to drive along with the cars and number plates.

I should of done more at the scene by taking pictures but was shook up. I am still very weary at junctions now and feel i am taking extra time now before pulling out.

Its like my confindence has gone :( But i suppose its like they say if you fall off a bike you have to get up and back on and carry on, just taking it easy for now.

There's no harm in sending this off to the police officer concerned.

Although it's more likely, that your insurance firm would address this with them anyways ;)

Keep copies of everything and I'd give a copy to your insurer along with the strongly worded letter.

I think I'd get some more pictures of the car with now added damage and send a copy of that to the insurance company. They are blatantly taking the pee now and I think your insurance co will appreciate such evidence to help your case.

As said though once you have given them your evidence let your insurance deal with it and if it makes you feel better tell the police about the damage and show them pictures of your car and their car and how the damage has increased.
