When something is so blatantly obviously the other parties fault you are entitled to be put back to the position you were before it happened and if the insurance company, or companies, won't pay enough for that then sue the driver herself in the small claims court.

People seem to overlook the fact that ultimately it is always the driver who is responsible for his/her actions and, aside from being a legal requirement, insurance is no more than a convenient instrument to shield them from the full financial consequences of a crash, it does not absolve them of responsibility.

PS: You've got to be proactive and affirmative, you can't sit and wait for them to get back to you, you have to show them you mean business.The minute they start to mess you about get a solicitor on the case and have him send the whole bill to the bitch, and that includes the cost of the courtesy car and any other out of pocket expenses !

tell your insurers you have photos of the scene and they include skid marks on the road from both parties. from what i can make of it you were doing about 10-15mph max and was already up on the embankment, she looks to be going 40 mph ish and looking at how late she left it to brake thought you would jump off the road for her. dont forget to get the alloys checked and a full geometry on the car through her insurance.

is that the police in the pic? if so im sure his report will make for intersting readings, did you get a pic of her car in case she tries to claim other damage?

the woman that drove into the back of my car at a roundabout tried to say the accident was SWMBO's fault (as she was driving) and there weren't any brake lights to let her know that SWMBO was braking to stop at the roundabout, only she didn't damage the brake lights so when the copper at the scene went to check out the brake lights they obviously worked and she then had to admit to looking at the accident that the coppers were at on the side of the road as they saw and heard her running into the back of my car.

As a result I've been driving an 08 2.0tdi VW Passat Estate Highline since Thursday as my car has been in the body shop. The amount of friends and neighbours who keep saying "nice to see you going up in the world & that must be so much nicer than the Skoda you used to have" I can't wait to pick my car back up at 8am this morning and be able to tell people that I liked my Skoda that much that I went and swapped it back ;)

Hope you get it sorted soon Garry, in the mean time drive extra carefull in the mondeo and extra money you save in fuel put towards giving your car a treat when you get it back :thumbup:

As a matter of interest what was the other car.

Judging by the width of the skid marks it was quite big although the actual tyre widths look rather narrow.

Thanks for all the comments, yes shall be fighting this one hard. The car is now at a friends garage (Aston Martin specialist Alan Smith A.S.Motors .. Home) so he will be doing all the repairs and setting up for me. He did all the suspension setup and geometry before and really know how to make a car handle.

The other car was a MK3 Astra. Sadly i did not get any other photos of the scene. Bit silly i realise, should have just snapped away.

Yep, will be treating Tyronne to some nice toys when i get it back. Still got 4 new Eagle F1 Assymetrics that were due for fitting on saturday sat in my garage. Think i will use the saved cash towards my FMIC mods. Still need to get a right hand entry inlet manifold.

Sounds a bit like what happened to me last september, only I didn't have the advantage of a dry road and daylight to prove any marks on the road.

Despite photographic evidence showing the width of the road etc I still got stiffed with a 50/50 which has put my insurance up £80 this year! (And the payout to the other part was only £126 - hardly worth claiming, stupid bint!!!) Grrrr.

Hope you get it all sorted mate but don't hold your breath for a clean insurance ending, guaranteed you'll end up paying more despite it being pretty obvious who was to blame.......

Yeah, thats exactly what im getting ready for. Its just such a pain tho :(

Oh well, lets see how it goes. Alan Smith has put the quote in now so i guess we just wait for them to give the okay. Then i can at least get my car back.
