as some of you may know I was expecting to take delivery of my vRS on the 1st of September, this is now due to be delivered at the end of the month. If the dealer isn't telling any more porkies.

I've been speaking to another *helpful* dealer who's trying to get me one asap, Am I within my right to cancel with the 1st dealer? They are in breach of contract as the car was supposed to be here on the 1st. Although the order form I've signed only says registered in september and not the date, although I have a verbal contract with them for the 1st.

You can cancel at any time upto the delivery date, AFAIK. The deposit is there to cover their administrative costs and to discourage people from being fickle, so they may well want to keep it if you say you want to cancel the order. But based on the history of the issue they may well return it...

Unless you have a specific date for delivery in writing you will find it hard to prove that they promised you the 1st and they could hold you to the contract.

It sounds however that they aren't that desparate to keep you as a customer if they have offered the deposit back so they may be happy for you to walk away.

I wouldn't do anything though until the other dealer confirms that they can get you a car by a specific date in writing , afterall both dealers should in theory have access to the same cars that are on Skoda's computer system.

Was yours a special order with extras , or just a plain VRS?

To be honest the problem is they could get fussy if they wanted to as you are breaking the contract. Verbel Contracts tend to be worthless, everything should be in writing. If you wanted car 1st September that should have been on form. Most dealers on the order form put TBC in delivery date box, my dealer did but I wasn't bothered or in any hurry.

it's a black octavia with cruise and parking sensors (sensors are being fitted at the dealership, only found this out last week - they said that they'd be identical to the factory one, they aren't though as they are mounted differently)

They've not offered to find one from another dealer that has one in stock. There are some out there, should they have looked? They have only had the skoda franchise for 3 months!

If it wasn't for the fact that I'd sold my car, then I'd have cancelled then and there. But I need a car for work.

I am now, sold my car a couple of weeks ago and have been driving a 'Getz' that they've loaned me, people keep asking me "is that your new car???" Cyclist's keep over taking me!

Well if you ordered and specified factory fit sensors, then dealer fits in a different place that may well affect resale values (may).

I was thinking that I could reject the car for the very reason that its not what I ordered, I ordered factory fit ones and not dealer fit ones. I think the dealer might fit cheaper non-skoda ones?

If they'd be honest with me from the very begining then I wouldn't mind the wait. Its just they've lied to me since day one.

I was looking forward to driving a new car on the 1st, 54 plate and all that rubbish. I'd imagine that prices tend to be higher for the September rush, are they slightly cheaper now?

thats what i thought, why pay a deposit if your legally bound to buy it!

You see before you reject a car you must give the gargae time to put thing right. In this case they have offered to install an equivalent product and I would think it would be hard to convince that it was case for rejection.

Presumably you have signed a new/used vehicle order form? The standard (Skoda) one I signed in 2002 includes this clause in Terms and Conditions:

4. a). We will try to ensure delivery of the goods ("goods" in these Terms and Conditions is defined as our sales to you) by the estimated delivery date (if any) but cannot guarantee the delivery date. Except where delay is caused by circumstances beyond our control you will be entitled to cancel the contract and receive repayment of your deposit if delivery has not taken place within 28 days of the estimated delivery date unless you have agreed otherwise, orally or in writing to accept late delivery. Where delay is caused by circumstances beyond our control we will not be liable for any damages related to the delay and in these circumstances we will contact you and agree an alternative date for delivery or you may cancel the contract, in which case any deposit paid by you shall be refunded in full.

Read the contract you signed carefully and you should find the answer to your question.

I have had exactly the same problem with my Fabia Vrs - i ordered it 10 July and was promised a 1 sept delivery date - I was verbally quoted week 32 build date. At the end of August i was told it was in the country and on schedule for delivery the following week.

They then called me a few days later and told me that they had made a mistake and my car was actually not scheduled for build until week 39 and the earliest i could expect it was 2nd or 3rd week of Oct.

The difference between parking sensors in the bumper or the rubbing strip would be seen as so minor a difference that it wouldn't be grounds to reject the car if that was the only fault.

This may sound like a daft question , but have you actually spoken to the garage about this?

Tell them that you are having doubts that they will be able to get you your car within a reasonable time and that another dealer claims to be able to get one much quicker.

Ask them to put a new date in writing , and what their position would be if you wanted to walk away from the deal.

You've waited all this time for your new car so what difference does a couple more weeks make? I'd make sure though that you get something in writing from the original dealer.

Regarding the parking sensors I don't know what the big deal is. What does it matter if they're factory fit or not as long as they're fit for purpose and the job is of a quality you'd expect from a new car - it certainly isn't cause to reject the car imo.

now this is one of my major concerns, if there's anything wrong with the parking sensors they fit then I'll have to take it back to them... Other warrenty work can be done else where i guess.

The parking sensors well there are not what I ordered for starters. They've never been honest since day one.

Just been on to legal team at work, they've said that because I've accepted the loan car then I've accept that there is a delay. I'm going on holiday tonight, so legal people have said that I get in contact with the garage when I get back and give them 7 days to deliver a car or I'm within my rights to get it else where.

i haven't heard from them since getting the loan car, it would be nice for them to give me a call and let me know where the car is.
