Anyone had a claim against a council recently for damage caused by potholes?SWMBO driving home last weeek, goes into a puddle, which contains a pothole, damages front nearside alloy (deformed rim and scraped edge), I now have to replace said alloy (LE 18" Monza IIRC? Can anyone confirm the price of these?), don't want it to be an insurance job - will I have to pay excess for example if I make a claim? I use More than just now. I can live with the scrape on the alloy I have, but my new shiny LE alloy is not looking the best. Do you need to replace the actual alloy to get thr ball rolling for a claim?Also have a claim form coming from council who are liable for road upkeep.Grey area for me. any views would be appreciated.

I threatened legal action against SCC after I hit a pothole near where I live, but after providing photographic evidence & measurements of the hole to them & after a very protracted delay I got all but £5 of it back.

New wheel & tyre £221, I got £216 back.

I claimed against North Yorks police a few years back about a damaged alloy caused by them. They paid for the repair.

Get decent pics and measurements as above.

Be prepared for a long fight.

What I heard based on the Irish system (Which is very similar to the UK on most legal matters) is that if there's evidence that the council attempted to repair the pothole before you suffered damage as a result of it, you're pretty much guaranteed a successful claim.
