I have a feeling that it would be your fault as it isn't your right of way, regardless of what lane/speed the other party was doing.

By all means submit the map to the insurance company but TBH I can't see how you will come out of the claim fault free.

I was already out of the junction when he changed lanes into me.

Well.. I was emerging from the junction, but surely that means I was in the nearside lane when he hit me.

Was he indicating? Gonna guess not though

I think it would probably be viewed as your liability as you ran into the side of his car, I think you would do well to go 50/50 tbh.

Well I have 1 witness, my passenger, and he has 2. But surely the damage on the cars and how the cars travelled after the collision should prove who did what, because I wouldnt have pulled out if I didnt believe he was in that second lane letting me out. And I certainly didn't pull into him, he sided the front of my car when he was swapping lanes.

Therefore we have no witnesses to the accident. It was 12.30am.

Also surely if I had pulled out on him, the front of his car would have been crunched not the side and he wouldn't have continued up the road, but ended up in the central reservation.

Unless he swerved to dodge you but didn't complete it in time, and only swiped you rather than T-Boning (not saying it is your fault, but looking at it from their side).

Only the last photo has loaded but looking at that it does look like he swiped you , best of luck with it. :thumbup:

All you can do is tell all pertinent info to the insurance company in your account, including lack of indication and the belief he was speeding. His story will no doubt be that you pulled out straight in front of him, sadly I think the end result will be you to be considered at fault, despite the fact he was apparently speeding and so on as you are unlikely to be able to prove this.

There's a chance the bonnet might straighten out and the corner can be painted up. The grille, wing, and bumper clearly need a bit more work though. Being hit that hard I wonder if there is any further unseen damage.

but if that was truth then how come his car is damaged half way down, and if he swerved to avoid me, how did he not spin on collision but carry on straight down the road, and how come i span out?

Oh I would also suggest mentioning that a claim of whiplash may be falsely made as she was complaining of pain at the scene. Whiplash does not normally develop until later so I think she was a big fat faker. Sadly all you do is go to a doctor, tense your muscles and go "ouch" when he prods you and you have a medically certified record that you have whiplash though which is very difficult to defend against.

So, it looks as if he has changed lanes into me or swerved to avoid me? There was no skid marks on the road, only from my car.

Have the police completed a RTC report? Ask them who they think is at fault. Ask the police for a copy of the report and submit it to your insurers.

I didn't get a number or anything, and because I was in shock and wasnt aware what was going on I couldnt explain what happened exactly but the coppers basically said 'i pulled out on them', which isn't the whole story. Oh and I explained my story to my brother (who works in the crime bureau), he believes there was something dodgy going on because they were trying to get me nailed for drink driving. Maybe trying to shift the attention from them to me.

Ring the police and ask them if a log was created for the accident, if the polce attended there will be a log. You can then ask for the police officer who attended to ring and speak to you. Ask them if a RTC report has been done and what was on it.

I don't necessarily want a report being used as evidence against me because I didn't explain the accident properly.

At the end of the day, we can all give out opinion and say what we think, but its down to the insurance companies.

I feel your pain tho, we have lots of dual carriageway in MK, i`m afraid this happens so often. Some people just look straight ahead, if they move over like this person, they dont cheak for emerging cars, or anything else. Even worse here, you can often turn right across the "motorway speed" traffic, directly opposite the turning for the estate on the other side. I`m sure you can imagine the chaos and near misses that happen everyday.
