Need help, turbo, engine, intercooler gone

Hi,

That's reassuring, I think they're trying to get me a second hand one off Ebay or something? is this right or should they supply me with a new one? you don't really know what you're getting with a second hand engine... also since i've now been without a car for 3 weeks, should they be supplying me with some sort of transport?

I could do with some advice where I stand legally now...

Do you have breakdown assistance? I know the standard RAC policy includes legal assistance cover - basically, you phone them up, leave a message, and they get a solicitor to call you back and talk things through with you. Well worth the cost of a phone call, and almost certainly more accurate than relying on us! ;) Your home/car insurance provider may also offer a similar service ...

Basically, you'd have to argue that they failed to act with "reasonable skill and care" (i.e. they failed to do/check something they should have), and claim the cost of repairs, alternative transport, etc, as consequential damages.

Note that this would be civil (probably small claims court), so the level of proof is "balance of probabilities".

Yea Got Breakdown through my bank, and had it through my insurance policy also, something I failed to mention was I cancelled my insurance policy last week because at the moment I'm paying £200 a month for nothing, i'm not sure whether I want to take them to court as my dad works there and it's an awkward situation as he booked the car in for me..., but all the info you have given me i'm thankful for

if the timing belt was done b4 the origonal turbo went then the timing belt has nothing to do with it. if the cambelt was fitted coreectly all is fine... if it wasnt valve /piston contact imediatly good bye engine no gray areas.

i have no idea why ur origonal turbo may have gone as i am only a self taught but i would of thought any mechanic worth his salt would of tried to find out why the turbo went and rectified all the probs and damage b4 replacing with a new one.

to my mind as this clearly wasnt done or the replacement turbo was damaged as long as u paid for a new one to be fitted or have some comeback/garuntee if it was second hand/ refurbed you should have to fork out any more money

Something along the lines of finding a replacement the same value as my old one? depreciation value?? and yea it's a proper Skoda garage...

It's getting quite a chore riding a bike into work in this weather hah

ment to say any forign matter in the engine will be caused by the replacement turbo. if it was there b4 hand i would of thought it would of screwed the engine b4 they replaced the turbo.

just seen that they r offering a second hand engine. if they refuse to supply a new one i would insist on a simular milage engine (if they want to play the depreciation game give it back to em) and a warrenty to cover the engine and any damage caused by the engine.

Yeah, I can imagine. Always best to try and sort things out amicably - small claims is only supposed to be informal, but I imagine it's pretty daunting and a fair bit of aggro - and add in the "relative issue" ... Best to know where you stand legally, as you can then be a bit more assertive (cos you know you're entitled to what you're asking for!). :)

Also, if you paid for the work done by credit card, your credit card company are as liable to the garage under S75 of the Consumer Credit Act (admittedly, the card company will probably just charge the garage back, which may end up with an awkward situation anyway).

Thanks Cooper, and Martinch, I haven't paid for the labour yet, my dad bought me the turbo from a breakers on his credit card, but obviously it isn't the breakers fault i now know... it's pretty frustrating though..

just an idea i dont know where u stand legaly but it might be worth contacting ur dad's credit card comp[any and see if u can get any refund through them. I know that untill u pay the bill any goods bought on the card legaly belong to the credit card company. maybe a strongly worded e-mail/letter from the company might shake a few trees?

Tbh it should be a new engine!

Even if they got say a 20k engine how do you know if its been serviced with the correct oil etc!

Id recommend an unhappy letter to skoda uk

Right, spoke to the owner today, one sided conversation, telling me there was a contamination in the engine which caused first turbo to go and caused second turbo to go, telling me him or myself cant put the blame on any of the engineers, saying he wouldn't of fitted a turbo on an engine with 129k on it any way, saying that it was an old banger, bloods boiling, back to square one, tried telling me same thing happened to his son so he scrapped the car, I said "so you would tell new customers that their car wont probably work over 130k", he said cars are very unreliable at this mileage and of course not they only come with 60k warranty....

so basically it's "forget about the £600 you just spent on an inter cooler and turbo" and buy a new engine (£500-£1000) and we'll wave all labour chargers

anybody got a response on a mechanics view?

I'm no expert in all things diesel or legal for that matter but why would they wave the labour charge for fitting a new engine, turbo etc (presumably this is quite a time consuming exercise) if they've done nothing wrong?? If they've done something wrong then they should pay all costs to put it right. If they've done nothing wrong then you should pick up the bill.

Offering freebies for NO reason is not how garages work.

Let's be very clear about this:

You took your Skoda VRS into a Skoda main dealer with a suspected blown turbo.

They replaced the turbo with a free issue secondhand part (something they would NEVER normally do) and the intercooler with a new Skoda part.

It then transpires that the engine oil pump had in fact failed which completely wrecked the engine and the replacement secondhand turbo.

You're not happy because they failed to correctly diagnose the problem, so they are waiving all labour charges and offering to replace the whole engine and turbo FOC if you can source a suitable replacement.

So you're out the cost of the secondhand turbo, Is the new replacement intercooler serviceable or did the second turbo failure damage it?

If so you should write off the cost of the secondhand turbo since it is much cheaper than the labour you would have otherwise paid.

Nothing the garage has done would have caused the oil pump to fail so what are you complaining about, they are being more than reasonable and in fact bending over backwards to help you.

So forget small claims court and all the other bad advice here, find a guaranteed low mileage engine and turbo and get them to fit it for free, it's a great offer and they're probably only doing it because your dad works there otherwise they'd tell you to pay up and p**s off and it'd be YOU in court for non-payment of their bill.
