basically... i put a deposit down for a demonstrator.. which was to become available in april

so all is well... until i did a search last weekend and the car i 'bought' was still up for sale? strange i thought...

so i emailed the salesman on monday - asking him for an update and what the situations is...

today is friday... still no reply, so i call the dealership....

"oh hi there, i was just thinking about you and typing up a reply" thought wtf is going on then?!

then he basically said... the dealership that had the original car, will not sell them the car anymore??? but we had already agreed to a sale price, deposit put down, finance all agreed and set into motion... we were just waiting for the delivery date.

so got option of either looking for another car, or return of the deposit.

I'm sure if it was the other way around my deposit would've got straight into the christmas **** up fund?!

That's crap service from a dealership that! Terrible, I say name and shame!!

Utter bullcrap if you ask me.

Deposit paid & hands shook = deal done.

Up to the dealer to honour the deal or it's next call Skoda UK.

i think i would get on to customer service and tell them whots gone on thats not good service for skoda

take your refund back and look elsewhere, find another dealer with morals not worth the hassle

With the law behind you if you have an agreement signed by both parties for the purchase.

I always assumed that a dealer actually owned their demonstrator cars, but perhaps they don't.

Nevertheless a Contract is a Contract, I suggest you read every word (twice) and then if you consider it air-tight take the matter up with your local Trading Standards.

Keep Skoda UK and the offending dealer fully aware of your actions.

have you read all the small print that is normally on the back of paperwork.

I don't think you will have a leg to stand on i bet they have this covered somewhere as they are clever most of these contracts have clauses that favour the seller.

It's just appalling to leave it so long to tell you the car was no longer available.

if the contract is signed then its watertight providing your prepared to push, ask them what they would have done had you failed to honour your part? they can actually pursue through the courts should they wish but at the very least they'd keep your deposit. they cant have it both ways and your legal rights are as good as theirs providing its signed by a company employee. try citizens direct if you need weasel words for the 'breach of contract' letter youd need to write to get the ball rolling

as an example, we had a contract for a used pug where several items were agreed to be rectified prior to delivery. they werent as 1 turned out to be an entirely new rear screen which was well over £500, and after several heated arguments i wrote the letter and after several phone calls it was replaced as the company director told me its a contract and they have to honour it, end of

personally i HAD to pursue this as we had taken delivery and paid for the car in full before we'd noticed it hadnt been done but your case is slightly different and it depends on whether you can be ar$ed. me i like the challenge :devil:

I would say push them to do the deal.

Please also name and shame them.

I think its sh1te how they have handled this, and agree name & shame is the best policy.

Two things I would add though, firstly don't spend a silly amount of time and money chasing a deal that probably won't happen. Walk away and refer to my first point.

Secondly, if the dealer has refunded your deposit, no court in the land would force them to sell you a car. You have actually not lost anything and therefore what you be claiming for?

I would just let as many people know what they did via as many channels as I could, starting here!

Also, if this is how they treat you before you have purchased, think what their aftersales service is like, best avoid.

Thanks for all the replies guys!

I've been away all weekend so haven't had a chance to go down and speak to the salesmen yet, but each time I'm thinking about it, its making me think why should i even buy a car from them now

yes their customer service is appalling, why wait this long to contact me? and would they of even contacted me before April? before I've sold my car privately and had to take out a rental for the remaining time?

what annoys me even more, is the fact that i asked him on Friday to see what cars are in the list so i can just purchase one straight away (used and new).... guess what? - not heard a thing!!!!

just been a right big pain in the ass really - think the best thing to do is just get the deposit back and go elsewhere - then ill name and shame... not before in case i don't get my deposit haha

went in yesterday to sort it all out, walked through the door to the most apologetic salesmen ever!

basically said, that the car they tried to source, wouldn't sell it them any cheaper than the asking price, thus making them lose out of the deal.

contacted trading standards before i went down and they basically said i had two options, either get the deposit back - or make them honour the deal

i thought if this is the service I'm getting now, whats the point making more grudges and enemies with the local dealership - walked out with my desposit...
