Car accident -settling for cash: Advice please

Hi folks,

A friend of mine reversed in to another car in a supermarket car park. No injuries as it was a very low speed collision, however the other car has some damage. She asked if she could settle outside of an insurance claim and the other driver is happy to do this. The other car owner has had two written quotes for the repair: £465 and £490, however he is thinking of getting a new car and has been told that the damage will reduce it's trade in value by £300 against a car that he has his eye on. He said that he would be happy with the £300.

The guy seems fairly trustworthy. My question is under the circumstances does she need to get a receipt and is there anything that would need to be worded in to this etc. having never done anything like this before.

Id definitely get a receipt stating that its for all damage and any injuries and that it is a full settlement

(she should have informed her insurance, as they require her to, but very few do that, some learn the hard way.

Is he taking full payment of only £300, end of. She needs to get him to write down what he is agreeing to & get it witnessed.

I would wonder if it is even his car or it was insured.

What he probably has, is 2 written quotes and someone that will do the job for £100.

Go to any bodyshop and say insurance job and the price atleast doubles, say you're paying for it and the price is lower. That's from experience lol

I'd agree with that, and make sure the words 'full and final settlement' were in there to avoid comebacks.

Have done the deed. We went and met the guy -seemed pretty decent chap (ex-police). He was happy to sign the receipt and actually suggested on one before she mentioned it.

As far as I'm aware there is no obligation to report an incident of this nature to the insurance companies as there was no personal injury and it did not take place on the public highway. Doing so gets mediately noted and seized on as an opportunity for the insurance company to make money by raising premiums regardless of whether a claim is made.
