Long story short, My ex stole this car from me, and I'm currently trying to go through court to get back the money she never paid me for it. She has since sold the car and denying any ownership of it. All I need is the current owner to have a receipt of sale signed by her.

You can usually do this through DLVA or at least you used to be able to.

I have been through this with a vehicle that was mine & proved as mine & someone sold it.

It went through the courts, but not the Civil Courts,

it was actual theft & the thief was prosecuted.

It is a Police matter. Even when the Police do not want involved, that really is not the case if a theft has taken place.

How is it a Civil Matter in your case?

Personally mate, your story sounds dodgy as f**k.

If what you've said has happened (which is may have) then report it to the police who will be able to trace the new owner via the DVLA and since you were the registered owner and keeper they'll be able to get it back for you.

The taxdisc expires at the end of October 2012, and its not been redone yet.

I would go to the police, it may well mysteriously appear if they become involved.

It's insured at least.

The DVLA won't be interested in who owns the car, only that is taxed for the road or SORNED. The Police also won't want to get involved as it really is a domestic argument. Your ex. could just say she gave you £XXXX some time ago and you never gave her an invoice, the argument can go on and on.

Just right it off as part of splitting up from her, your not going to get anywhere on this one.

However, if it was in her name, she didn't steal it and therefore I cannot imagine your request would be appropriate. If she forged your signature, you have a potential criminal offence and the Police would be interested.

That is correct, but then you can come up with details and receipts that may show probable ownership.

Or ownership at some point.

Proof of purchase, proof of buying and paying for the insurance, road tax, paying for the services.

With you also being the registered keeper, it all helps.

Basically, It was in her name purely for insurance purposes, I bought the vehicle. She paid a partial amount(30%) to me, promised me the rest before we split etc(which I do still have messages etc from her proving this fact) She since changed her number and has not responded to letters detailing court action. I have spoken to solicitors, who have basically said its up to her to prove she paid the full amount to me, not for me to prove she hasn't. I have proof from the DVLA that the vehicle I part ex'd against her car was in my name and then the previous owners of the fabia.

Sounds like the best bet is to fill in the necessary forms for the DVLA and get the info off them. Other than that I suppose you could report the car as stolen (which may cause different problems)!

I tried this originally, but police had no interest in it. And now shes sold the car, I dont want to cause problems for the new owner who will have unknowningly bought it.

Couple of points.

If the car was in her name on the V5 then she was the registered keeper.

If you gave it to her, then under Law you gifted it to her, even if she did say she "might" pay you for it., and paid something towards it.

Text messages do not make an easily enforceable contract.

It is up to you to PROVE that the car was yours, and that would be admissable in Court.

Two options I can see:

1/ Walk away and learn a very expensive lesson

2/ Consider taking out a Small Claims Court action against her, but ensuring you have admissable PROOF that the car was yours.

I think this comes down to your word against hers, but I can't see what the "insurance purposes" are for her to be recorded as the owner.

No he wasn't fronting for me. It was her car to drive daily, and she was paying me back. I had a 350bhp lcr insured at the time so insuance costs dont bother me.

Unless you have outright proof in text from her acknowledging the car is yours and she would pay you back, you have no admission of guilt.

I had a problem recently where my ex knowingly took an engagement ring from me. I had never proposed, and she buggered off with it. She's not very bright, and admitted in a bravado text she had knowingly taken it. That's your proof. I had it back in less than 48 hours after some gentle persuasion. If you have the original sales receipt in your name, this will help things hugely. Finance you're paying off helps too, as it's in your name. V5 means **** all.
