I decided to contact vosa about the DPF and MOT issue as opinions vary depending where you look. Here is the reply, I thought it might be useful

Dear Sir.

Thank you for your email enquiry dated 8th February 2013 concerning DPF's..

Removal of a DPF in itself is not a reason for failure at MOT.

There are no current plans to introduce this however if you wish to receive

updates from VOSA (where, if introduced, this information will be

What they didn't mention was that they have halved the smoke limit for cars registered after 31st July 2008. A car without a DPF should be able to meet this new limit.
