BTW - Looks like they just posted the adaptive cruise control that was meant to be included in elegance... £450?!?!??!!

ACC was always going to be a cost option in the UK.

Isnt it great when you go to collect your new car, as long as its not peeing down which spoils it a bit by actually getting it dirty ! Give it a good look over - that's what I like about these forums

  • Sorry matey, you ask a innocent question and this ensues!! I'm sure you'll enjoy your new car when it arrives

  • So far my dealer, Sparshatts of Botley, Southampton, have been very good. I was emailed as soon as they knew the production week, again when the car had been shipped to Emden and again when the car wa

I could have sworn that the first brochure (the march one, without the estate on the cover) said that they were included in Elegance trim. If that's not the case then faux outrage is withdrawn :-)

If you read the March brochure carefully, wording is a bit mis-leading imo but I read it to be that only the front assist will be standard on Elegance, ACC would be an option but in the text for ACC it refers to the "front assist radar fitted as standard", so can understand why there is confusion!

I got a phone call from SUK on Friday, and asked about the front assist. They said that it was meant to be included from build week 23, but got delayed. As of Friday, the provisional build week was 27, but that had yet to be confirmed by the factory.

No rear camera option on the octy III?

I did not see the option although you can opt for the automatic parking system.

I have ordered an elegance which arrived at Emden on Monday.

As it was taken from free stock I have no idea which build week it is.

Does this mean I won't have it??

I have a march13 brochure which says " standard on elegance trim" and a footnote "available June onwards (please see your local retailer).

I hope it is there, and if not, what could I do??

If you mean the front assist option as it is only being included from week 23 or 26, depending on who you listen to, it would seem very uinlikely that your car will have it. But you never know, stranger things can happen....

If it is not there, you are entitled to cancel the order as the car is not to specification, or ask for a replacement car...that'll take some time though

The car is to specification it is just that specification changes, If someone accepts a stock vehicle they are accepting the specification at the time the car was built. The brochure states on the last page that the information in it is not binding.

They can say that as much as they wish, but if the car was advertised as having xyz and turns up without it, then you can rescind the contract. Only if the salesman informed you it would not be fitted would you have any obligation to accept the car, stock vehicle or not.

I think you've got that the wrong way around. The poster could reject the car if it didn't come with something which he requested in writing, but as it appears he hasn't he would be on a very sticky wicket regarding getting his deposit back. Most manufacturers brochures state they are not binding to protect them from this very fact.

As for being able to demand a replacement car on the same terms as he originally ordered, you are definitely wrong.

Read the sale if goods act, it's pretty clear.

You cant reject a car because it did not have an option on it which was not available at the time of the order - the car he ordered was what he got. Its always the same with a new car and options which then become standard at some later date. I am in the process of ordering mine and I will get a couple of things which are not available until week 26 onwards. Anything additional which gets added as standard after the build date then tough boobies. That's life. Sale of goods act will not apply as he has not received something he did not order. Just saying "I wanted it but it wasn't available" isn't enough in law and if you want to reject the vehicle on that basis then best of luck !

The brochure says standard from June onwards in elegantcetrim. The guy has bought a car in June in the elegance trim. Therefore if it doesn't have it, then it is not to spec.

You may know the ins and outs of Skoda build weeks and delays, but joe public cannot be expected to, they have to go off the info given.

Phsroberts, the guy came on here for advice and you are not helping him one bit by giving clearly wrong advice.

I don't know whether he's willing to accept the car without the front assist, and to be honest it's not my concern...if he wants to reject it and get his deposit back he can. I'm not interested in your opinion.

I can tell ! You sound like the worst type of barrack room lawyer that isn't interested in facts either. The Guy said he didn't know the build week for starters, it arrived at Emden on the 10th so could easily have been built in May, as I've had a previous car take longer than 10 days to arrive at the port. Going back to specifications change all the time that's why the disclaimer is put there. Regarding front assist it even says available from June but to check with your local retailer!

Get out clause on the bottom of the back cover of the brochure :-

"The information in this brochure referring to specification, design, equipment, material and external appearance relates to the time at which this brochure was printed. Whilst every effort is made to ensure its accuracy, the information in this brochure is not binding and is subject to alteration. Some illustrations in this brochure depict left hand drive models, with both standard and optional equipment shown. Please confirm exact specifications, prices and colour availability with your SKODA retailer who will be notified of any specification changes as they occur"

Pretty cut and dried I think.

This is fun

Is this the five minute argument or the full half hour?

If it hasn't sunk in now it never will lol :)

To answer both of you, I did not ask the specific question of the dealer as to whether this would be fitted. If I had, and it was not, then I think I would have a case.

This was not a priority for me, it was just something I looked a bit more into AFTER the order. In the same way, I ordered the car, and after realised that the Alcantara comes in two different colours so phoned Skoda to find out what colour the interior would be.

I hope it turns up with Front asisist, but if it does not, I wont be rejecting the car.

so, please stop arguing on my behalf!!!!
