Just for arguments sake someone buys a car not knowing its been mapped then has an accident and it's noticed it has been, where would they stand legally? I'm not suggesting don't tell insurance companies, I have recently sold a remapped vrs which was all insured properly, I supplied all the graphs and receipts in with the car but never once mentioned it had been mapped. (Traded it in) just say they disappeared and someone bought it not knowing? Also I have read numerous threads on here about people who think there cars have been mapped then later find out they have. Things like that would only be noticed by car lovers and average joe wouldn't even think about it.

The person buying and not knowing, then having to make a claim. or having the vehicle inspected and checked will give their statements if still alive.

 

The Police or Insurance Examiner or Loss Adjuster will then possibly look to see if that declaration is truthful.

Go to where the person bought the car.

Ask them if they were aware of the car being Modified, Re-maped etc.

Maybe ask the Previous owner,

That would be like you.

 

So its going to maybe matter if the car is involved in a Fatality, or Life Changing Injuries or just maybe Insurance Fraud or 

being non Insured.

 

Loss adjusters check Car & Moding Forums, Pictures of Track Days etc.

& might ask Someone putting in a claim for an accident with a vehicle that is not as Insured, to provide some documents so that they can look at Credit Card, and Bank Statements etc.

to see if they have bought Performance Parts or purchased a Re-Map.

 

Or the question might never arise.

It's one of the principles of insurance - an insurer will not repudiate a claim or void a policy where a policy holder has not declared a material fact that he was not aware of.

A material fact is any fact that would influence an insurer's judgment in accepting a risk or the terms / premium applied. If a proposer is unsure as to whether a fact is material he should still disclose it to the insurer to let the insurer decide.
