 I posted this in the Superb II thread but whilst writing the post I thought of some questions.

 

Despite the other drivers insistance I was in the wrong (I wasn't, see below) I am curious how this is going to affect my insurance.

 

I plan to ring Admiral in the morning but as I was not at fault am I still going to have to stump up my excess?

 

I can't prove I was in the right, the only pictures I have are of the post-bump scene so will this be a knock-for-knock claim?

My pride and joy has suffered some damage this evening. 

 

New roundabout so everyone is still learning the lanes.

 

I was in the left lane heading straight over the roundabout (A688 East), the lorry was in the next lane to my right (A167 South).

The lights change to green and we both enter the roundabout, the lorry does the same as this Citroen Picasso except I'm on his left...

I'm half passed the lorry with my rear door level with his front bumper and he drifts over into my lane. I swerve left up to the kerb and stop but its not enough...

I can't see how he's going to be able to explain that as your fault.

I would get these two threads merged together, ask a mod to do it.

Sorry to see that, but agree with Dr Z. I can't see how he can say anything other than sorry I c**ked up.

Based on what you have said there's a phrase that describes the lorry drivers behaviour:

 

"Driving without due care and attention"

I would say the problem you have, unless he admits liability, is to prove that he moved across into your lane. He can always argue that you moved across into his lane. In the absence of an independent witness to support your account of events, or an admission by him, it is likely to be knock for knock.

It is certainly an option to consider but depends on your individual circumstances of course.

Witnesses?

If the bloke continues to talk rubbish or start saying you pulled into him then I would threaten to take him to small claims court and ask him if he is willing to stand up in court and stand by what he has said.

Sorry to see this, the more I see posts like this the more it really boils my ****. If I make a mistake I own up, as others should. I really need to get my arse in gear and get a dashcam.

It's a shame you haven't got any witnesses.


I hope you sort this out in your favour. Maybe call his company and see if they install cameras in their trucks?

Your pictures show the scene well, & your description.

If thats what you put to your Insurance, then the witness and the Lorry Drivers Statement should show where the blame lies,

unless the driver tries to say you went to change lanes to your right.

 

If they try for Knock for Knock i would not be accepting that.

Your in a much better position now which is great to hear as it really brasses me off when people like the lorry driver just try and front it out rather than admit they were wrong leaving people such as yourself out of pocket and stressed out. before your last post I'd have said get a price to do it without contacting your insurance and if it was less than £500 get it done because although this prang might not make much difference to your premium (though before it would probably have gone knock for knock so you'd have to pay the excess) if you had a second maybe more serious bang which ment you had to claim then your premium would then soar.

I really do need to fit my dashcam I've had in the garage for over a month now and your case really does show how invaluable they can be.

You need to tell your insurance very clearly what happened and the "claims" the other driver made.  Tell them that if the other driver tries to claim in any way that you were responsible that he is lying and you will not accept 50:50 responsibility.

 

I hit someone a few years ago on a roundabout and I'm sure it was a crash for cash scam but I didn't really push it with my insurer and they just handed out the cash to the other driver.

Reading things like this are the reason I got myself a dash cam, I'm glad you have a witness, hopefully you get it sorted quickly  :thumbup:

Result, a colleague from work was a few cars behind me and saw the collision.

 

He just emailed me now.

That is good news. When you contact the insurance company it is important to stress the independence of this third party witness despite his/ her status as a work colleague.

Bad luck on the damage, good news on the witness! It wasn't even a real lorry, driver should catch a grip of himself hes only about 4 or 5 feet longer than your big Octavia traitor tank! His all round visibility would have been bloody good too. I hate people who try to say it was the other persons fault when they are either just lying through their teeth or absolutely retarded beyond belief. If it was a company vehicle call his employer and feel free to complain about the driver too.

Did you mention the fact that you thought the Lorry Driver might have been on the mobile   :think:

You were ahead of him - the damage shows that - i don't see how blame is an issue in this case.

Thanks for all the comments guys.

 

Spoke with my insurers today and they warned me trying to aportion blame on a roundabout can be difficult.

 

They also had concerns about the validity of my witness with them working for the same company as me.

 

My excess is £310 so I made it clear to them that I won't be making a claim until their liability department are able to determine how they will aportion the blame.

 

Even if I am found to be not at fault I was told I will suffer financially due to it being recorded on my file.

 

Sheesh.

Tell me you have legal cover. If so claim, and use it.
