I've spoken to my solicitor and I'm ready to go through him if the dealer messes me about any more. I've also spoken to the DVA at length and they couldn't be more helpful, they are very happy to answer questions and help me. Basically the situation at present is that the car is taxed until March by the previous owner. However, I don't have the disc so he could claim it back, but it wouldn't be until January, so as far as the dealer is concerned there's no reason for me to not drive the car because it is technically still taxed so if a camera spots me it'll show up as taxed. However, if the Police stop me and ask me to produce the tax disc, I can't so the DVA say that's why I shouldn't drive the car because the Police could do me for that and there's nothing I can do. So according to the dealer, once the DVA receives the paperwork they sent them, I can tax the car over the phone in my name and everything is sorted, so I'm gonna ring the DVA every day to see if they've got it yet. However the issue is that technically the dealer sent off paperwork from an invalid log book, so the DVA still might not do anything until they receive the correct one (which is what started all this off). The dealer say however that it's no issue, they will get the DVA to sort it.

 

So ideally the DVA receive the paperwork from the dealer and I sort everything over the phone and can drive the car in the next few days. If not I'll ask the DVA for advice and go from there. The funny thing is I could probably sort it quicker myself by getting in touch with the previous owner and getting him to send me the tax disc and logbook

The police don't prosecute you for no tax, they report you to the dvla and it's the dvla who fine you IIRC, so providing the dvla have their act together you should be ok. Good luck

I'm sorry but I'm reluctant to name the dealer as I might be stuck with them for a while because I have a 6 month warranty but no it's definitely not a small time trader, it's a large dealership. I'm also reluctant to ask for a refund because I love the car and it was a good price for it. There's also the fact that they already have my old car for sale

Small point which I believe is important, but could of course be wrong. DVLA covers GB not UK so Norther Ireland has its own licencing organisation and possibly rules. So I think it is important that the OP takes the advice here, which is probably based mainly on experience with DVLA with a pinch of salt. Probably also means comments about V5C may not apply.

That said I cannot believe for a moment that what has happened is acceptable in any way in any part of the UK.

 

It is indeed different DVA in NI DVLA in GB. They have been meant to merge many times in the past and latest one im not sure if it's happening or not. Northern Ireland has it's own legislation so the Road Traffic Act in GB is not in force in NI. NI has it's own version which is broadly similar almost word for word. But things like VED are the same word for word. V5C in GB, V5C(NI) in NI the '(NI)' is the only real difference to the face of the forum. Same new one with the stuff about not proof of ownership etc, they started sending them direct from Swansea as part of the merge not sure if they still are. Totally different computer system also which is the big problem for merge.

What car did you come from? Is this your first Skoda? If you got it from a franchised main dealers contact their main UK customer services and fill them in, they should be fit to advise them accordingly. If it was a one man band job where it's all in his own interest, you'd half expect the response. But if it's a salesman or sales manger putting the brakes on, kick off there too. Don't be afraid of next time as a customer, all will be forgiven and he will be your new best friend again lol.

No difference on that front. Just administered by a similar differently named government body and offence listed would be against a difference Act and Section. You can use a NI 'tax disc' on a GB registered car and vice versa ironically. Only possible if you move a car from one to the other and elect to not change the registration you are allowed to use same one if it's not out of date. As money goes to exactly the same pot.

What car did you come from? Is this your first Skoda? If you got it from a franchised main dealers contact their main UK customer services and fill them in, they should be fit to advise them accordingly. Yea this is my first Skoda. My old car was a Fiesta I got at Mulhollands in Randalstown

It is the same, but the black&white being you needing to have one. Despite while they may sympathise with your situation, the person you deal with on the phone will not be part of their prosecution team. I know one of the former prosecutors in the County hall in Coleraine, if the PSNI were to submit a report, it's not really for them to then turn a blind eye sort of thing.

They like many dealers have their own little section on this forum, where you can put questions to them, make suggestions and complaints etc. They seem to reply to the relatively small number of customers who are on here. Mervyn Stewart on the other hand I am not so keen on in the service side of things due to past reputation and complaints (not from on here). 

 

If you got car from somewhere like Charles Hursts.............. that place is a bit of a mine field! 

Did you only get a 6 months warranty because this is not an 'Approved used Skoda' with a 12 month Warranty?

 

You say they are selling your car,

is that a sale of a 'Customers car', as in you did not Trade In and get money towards your new purchase?

Or is your car Traded in?

 

I still think the Dealership are taking the Pith, they could have got the VED for the vehicle, they had the car 'In Trade',

or maybe they did not,

very odd situation with the Dealership IMO.

Yeah Mulhollands were very good when I got my old car, but I went to them again this time to look at a couple of cars and the trade-in value they gave for my car was totally unacceptable, I only put about 10,000 miles in it since I got it and they offered me less than a third of what I paid for it. Despite all this messing about, the place where I got my new car were great (before they had my money of course). They drove the car about 20 miles closer to me so that I could test drive it for example. I traded my old car in the same as is usual, nothing funny about that

 

Despite the dealer messing me about, the car is only 2 and a half years old so if I can get all this sorted now I doubt I'll have to go back to them again

Where about's are you from? 

I am surprised the dealer did not tax the car on your behalf.

 

The small dealer I just bought my new Audi from, put 12 months tax on it for me using their trade insurance policy from a local post office. I just turned up, paid for the car and tax and drove off. At the point they taxed the car, I was not even insured to drive it. The car is now shown as taxed on the DVLA site and ASKMID obviously has the car as insured.

Have you only got the remainder of the Original Warranty, 6 months

 did you not receive a 12 months Warranty on a used car.

 

Maybe worth looking at buying a 'Skoda Extended Warranty' when the Warranty Expires.

1 or 2 years are available.

May be different in NI, But here in England and Wales the police can give a fixed penalty notice for failing to display tax.

So the DVA received the paperwork from the dealer yesterday and despite them telling me they'd have it processed today, I rang and they haven't. They might have it done on Monday they tell me now. So a whole weekend without a car, brilliant. Getting ****ed off beyond words to be honest. I've already spent about £50 in taxis so far. There's still a good chance than when it's processed they'll say I still need the other logbook anyway so there's no telling how long I'll have to wait if that's the case. I spoke to the dealer again yesterday and told them I could get done by the Police for having no tax. "The world could end tomorrow as well" was their response, cheeky ******s. If there's nothing by Monday I'm getting in touch with Trading Standards or I'll try and go above the dealer to someone above them that takes to do with all of the network. There's no way I'm going any longer with no car and no form of compensation or reimbursement to speak of. It's frustrating because it doesn't seem like there's a whole lot I can do. Fingers crossed it's sorted on Monday but I'm not holding my breath

I'll be honest with you, I have no idea why you are bothering and allowing this melodrama to continue. Do you honestly believe they will look after you if your car fails during its warranty? Just get rid of the car back to the dealer and be done with it. There's always a better deal out there, just get another one.

I believe there's little chance of anything happening during the warranty, the car is only 2 and a half years old. I've been looking at buying a new car since about last March and this is the best deal I've seen. If I ask for my money back I'll have no car anyway.

 

Perhaps it sounds silly but I don't want a refund because then the dealer is better off than they were before I went. I don't want them to be able to wipe their hands and get rid of me

I hope you are not going to use your money to buy the VED.  They can make that gesture and pay that.

After all,

they are due you compensation, and should be supplying a Courtesy car, and no Insurance charge.

I got it from a large franchise of dealers who sell a variety of used cars. I looked at a Fabia at a Skoda dealer and I would have got a 12 month warranty with it but they wanted £2000 more for an inferior car to the one I bought

Yeah I'll get some pics, though I doubt it's anything anyone hasn't seen before, it's a black Monte Carlo. I'm in Larne so I'm a bit out of the way and my insurance on a car like that would be insane though they do look nice

 

So (hopefully) a final update. I rang the DVA today and everything is sorted thank goodness. The car is registered in my name and the tax disc is in the post. I am confident I'll never have to go near the dealer again. Thanks for the advice and thoughts everyone

My DVA saga has begun apparently their computer system is down that has been for over a week stopping them being able to give me a reg and tax disc today........ Not exactly handy will call me after holidays to sort then. Paying mega bucks for 2 insurance polices in the mean time

What? I've spoken to them literally every day since last Monday (apart from the weekend) and nobody mentioned anything like that

No reason why they would, it's only a system they need to use for cars being imported from outside of the UK.
