73 in a 60 - NIP dated 18 days after offence

Featured Replies

My first offence after 13 years of driving, and it happens 3 hours after picking up my used Octavia estate from the dealer!

The thing is, the offence was on the 2nd Sep, and this NIP letter is dated the 20th. Does that mean it's too late ( > 14days) and they cannot give me the fine+points (as long as I send it back naming the driver, etc) ?

The camera was a mobile unit parked at the roadside.

Thanks,

B

I think you are probably out of luck here.

The NIP would have been sent to the registered keeper on the day off the offence which almost certainly would have been the garage that you bought the car from.

It is only this first NIP that must be sent within the 14 days. If it takes them longer to track down who actually has the vehicle then thats fair game.

The garage will have replied saying that they sold the car to you and the second NIP to your address would have followed on.

N.B. I HAVE NEVER DEALT WITH A 'NIP', JUST TRYING TO HELP.

This is 'hazy' as from what I'm reading, the NIP has to be ISSUED within 14 days (meaning by the 16th in your case) but the authourities are allowed 2-3 days after that for it to reach you (roughly 17 days). So you MIGHT be able to get out of this, just get a lawyer to write you a letter. For more info, read these links:

http://www.speed-trap.co.uk/FAQ/FAQ.htm -> look 4 'arrived outside of

Hope this helps.

ANON  '

As you had just bought the car and the NIP was sent to the registered keeper according to the DVLA's records I'm 90% convinced the usual 14 day rule will not apply :(

I thought it was after 14 days that you could no longer be expected to remember who was driving the vehicle and therefore not get the points!!!!

Thanks for the comments. Date of issue of the NIP appears to be yesterday, but I agree that the delay could easily be because they got the details of the previous owner and then had to find mine afterwards, so I don't think the 14-day rule will help me here.

I don't like the idea of 3 points for 4 years, adding to the car insurance for all that time. We have 2 cars as well so I'd have to pay more on both policies. Ho Hum.

Keep an eye out of some insurance companies. Some may move to insuring drivers not cars in the near future- might save you cash.

As for the rules, if the NIP is sent First time to the registered owner with teh DVLA at time of offence, within 14 days it is valid.

when you say dated the 20th is this the letter on the date or the day you got the letter?

That would be bloody good since I'm in my view paying over the odds for my potent road car than a 31 year old male should do, almost as much as a Citroen BX 1700 cost me 8 years ago and I've got a 15yr clean license... I must be registered as dead or somthing.

That said I'm sure jnr down the road in his 2 tonne stops in 6000yds corsa pays a lot less, because his rear lights don't work...

Gets my goat up it does.

Bad luck on the ticket, I suspect the newness of the car distracted you from the *I'm sure he was really honestly umm* very visible traffic officer of the banco de goverment.

I know I spend far less time watching for people now as camera vans or tripods and most of the time I'm not even speeding..dam I can't fib very well.

73 in a 60 won't be too bad though will it worse case scenario?

NIP itself is dated 20th, so wife tells me. Arrived this morning and she told me on phone. She's not that fussed about it. She was sitting next to me at the time.

I think if I'd been pulled over and explained it was new car, and was on way to wedding then maybe some leniency. Never saw the van until too late, certainly didn't see any policemen (camera out of top-rear windows van it was), and reason I saw van so late was it was nearside of road in layby and there was 1st lane traffic between it and me. I was also concentrating on the road, as you do.

But yes, 73 in a 60 is not too bad, but still over the limit.

BX 1700 ? Wasn't a TZD Turbo Hurricane was it? I had one of those. Great turbo and smooth ride but super-wallowy on corners. Most comfy car I ever had. Great brakes too.

I have sent an email to the local police safety gang to ask if they run speed awareness courses. It would be nice to go on one of them and not get the points. If the course costs about 150 quid then I reckon that's at least as much as my insurance premium increase would be over the next 3/4 years, so I'd rather pay the same money and get some knowledge than pay it and get points on my license.

Just to clarify, the points only count against you for 3 years but can not be removed from your licence for 5

YMMV but my insurance actually went down after I received an SP30, I'm sure that I read that not all insurance companies apply a loading for this offence.

From what I read, points apply for 3 but are removed after 4.

thought you had to get the letter within 14 days? could take longer with the postal system, but if the letter is dated the 20th then its not within the 14 days!

Yes , but as has been said a few times it has to be sent to the registered keeper on the date of the offence within 14 days which was the garage.

When the garage reply with the new keepers details a second NIP is sent out which does not have to be within 14 days.

right back to LAPD and ask them why its taken them longer than 14 days, they *might* not know why, A guy at work was in the same situation and they let him off because they had no record why it took them longer than the 14 days. Plus gives u longer to pay, better in your pocket than theirs!
