Speeding fine or ban

Featured Replies

Hi All, Just thought would ask on here as I know there are few people with experience of the legal side of things:

Brother got caught speeding and very rightly so got a court summons (82 in a 60), just wondering what the punishment/ruling will be with regards to the speed he was doing etc.

I am in no way condoning the speeding, it was purely to find out what the likely outcome will be,

Probably 3 points and a hefty fine, but it's impossible to say for sure without knowing the circumstances, force, court, and presiding magistrate.

22 mph over speed limit,  so 36.6%

So how long held licence, etc,  well he has been summoned.

So any points already,

Held full licence under 2 years,

Location, circumstances, etc etc      ............ Who knows what he might get.   3 points, £100 as a minimum.

Apologies,

License has been for 7 years, no points, was on Welsh back roads

Where in Wales?

He isn't to sure without checking the location, but either the A5 or the A55?

Looking at Google Maps they don't look to far apart,

So Brunstromia then? If so, then they're going to throw away the key mate! ;)

Haha, his fault then if that's the case!

I better use his car then  :)

Just did some reading on Brunstromia, seems they are good at catching the speeders!

Glad i googled that.

Must remember and avoid, or observe the speed limits very closely.

Look on the sentencing guidelines website and head for speeding, it's what magistrates are supposed to follow

So heard the news from brother, 6 points and a fine, didn't get a ban, and has very much learnt his lesson.

I'm assuming it was a mobile camera van as they are widely used in Wales. There's a bridge they sit on west of Shrewsbury on the A5 on a downhill section in the single carriageway between the dual carriageways if anyone goes that way. They also park up on a lot of the 60 limit roads in Wales as well as the usual 30 and 40 limit that camera partnerships lie in wait on nationwide but there's usually the small white camera signs to warn you. They'll be out in force in a couple of months after the bikers once the weather improves too. It's easily done and if your brother doesn't have a satnav with the camera sites in it now might be a good time to get one.

Think he may have marginally been just over the 3 points / fine threshold there.

My only indiscretion was doing 79 in a 60.  I thought it was a 70 limit (I was young and forgot 2 lanes doesn't mean dual carriageway if only paint separating the traffic) and was a bit over after watching a gumball rally start.

Ironic looking back - my car was a stock 100bhp back then :D

To be honest I think they've hammered him giving him 6 points with no previous, bearing in mind the guideline is 4-6 points for 81-90 in a 60

I know it says 'or 7 days disqualification', but unless there were any aggravating features a disqualification for a first offence shouldn't have been a consideration

Well, that was my serious underlying point; >20mph over in Brunstromia is an aggravating feature! ;)

Its done now, I did kind of think the same about 6 points with a previously clean license, but he broke the law and get the punishment.

Funny thing was it was a driving holiday he took to go and visit wales and to enjoy his new car at the time, I will recommend the satnav with camera sites in.

Did he get a solicitor?

I had 2 offences in my first 2 years and without a solicitor I would have had to retake my test again, but going to court and pleading that I needed my car for work meant i got off with a 21 day disqualification + the normal fine and court costs.

No solicitor this time, he just went up and got given the 6 points and a fine. Described it as being at school and being told off!

You don't need to pay a solicitor for that (although I'm sure they will insist otherwise), you just need to know the law

They don't insist anything, but when your 18 and a total knobhead it was £300 well spent in my book.

You're lucky it was that cheap

The legislation was brought in especially for 'knobheads' who show total disregard for the law within the early years of passing, so the court were also very generous to you, let's hope the penny has now dropped

Bit of future info for everybody regarding fpn's and a summons.

The A55 is a 70 Mph I believe, I travel that road quite a lot
