Got a nice letter form west mids police today telling me that I was caught doing 49 in a 40 today.

Fair cop and all that I probably was.

Any idea what are my chances of going on a speed awareness course or is it a fine and points?

I 'believe', even with an awareness course, you still get fine and points, just less of them.

 

According to a less than reliable friend of mine, at least.

I think you have to be offered to do a course.

If you go on speed awareness course you only pay for a course.

You don't pay fine and you don't get point but they are held for several years and if you over speeding again that points will be place on licence.

Check their website for their SAC policy

No points and fine if you do the speed awareness, just the cost of the course. Get caught again and you'll get the points for this time and the new offence. 

 

Last time I was caught (36 in a 30), it was cheaper to take the fine than pay for, and attend, the course.

In my experience... :( ...  if you're offered a course and do it, then there is NO fine and NO points recorded, suspended, whatever. There is no offence recorded against you unless you choose the fine and points option.

If you get caught again within a certain number of years (5? 6?) then you HAVE to take a fine and points, but NOT any held over from this incident. You don't get the course option.

As Paul007 says, check the police website - and wait for the papers to arrive then read them thoroughly.

I wasn't 100% on this bit but relied on memory.. I think you are more likely to be right than my shoddy memory..

Ive only had the NIP paperwork so far.

Guess I'll fill it out and see what comes back, at the moment I've only been asked to confirm who was driving.

Just curious as to where the threshold is for the course / fine only option.

You are inside the limit for a course, I would be surprised if you don't get offered one. You need not to have done a similar course in the last three years. So if you have done, say, a phone awareness course (in the last three years) that will not stop you doing a S.A.C as they are different offences. 

Speed limit + 10% + 9 mph course limit.

No re-offence within 3 years and you get a course again.

Whether you have to tell your insurers really depends on the questions they asked the last time you renewed.  If they asked whether you have attended a National Driver Offender Rectification Scheme course they regard it as a material fact and you do need to tell them.  If they didn't ask then you don't need to tell them, though if in doubt tell them anyway.  That way you are covered whatever happens.  As far as I am aware, there is only one insurance company (and its subsidiaries) which penalises those who have attended the course and that is Admiral (I believe that Elephant is also one of their brands, there may be others).

 

At that speed you will almost certainly be offered the course, if the offer is not made a request from you may well change their mind (it does happen).  The course will normally be cheaper than the fixed penalty and you will probably gain some useful information.

 

I recently had a guy on a course who admitted that he was on his third time round.  What made it worse was that I had presented all three courses, some you win, some you loose!

The following guidance from West Mids Police was issued in 2014:

The current eligibility criteria set by the West Midlands Police for admittance to a Speed Awareness Course instead of receiving a fine and points on a license is 10% + 7mph. We understand the existing recommendation from ACPO is 10% + 9mph, however, this criterion is provided as guidance only. It does not remove the right for local authorities to set their own speed thresholds.

On this basis you will be offered SAC.

Don't start. It's completely stupid over here. Almost everything they ask is on an electronic record they could just look up but they ask you anyway presumably so they can catch you lying when you need to claim and cancel your policy.

Over here that is unthinkable. The insurance companies have no access to speedingtickets and such.

They can ask you though can they not, ? and expect an honest answer.

(I think those in the UK are happier with this,

rather than how anyone can check online your Tax Returns as is the case in Norway.)

Maybe that is Freedom of Information just a bit too far for many.

Last year, is a 3 week period NW Police caught over 700 motorists speeding in the 50 MPH section of the A55 at Colwyn Bay.  They still have a Zero tolerance

10% + 9 sounds very generous, when I got a course Lincolnshire was 10% + 2, which was I thought in accordance with ACPO guidelines

 

That would mean you would still get offered a course for doing 42 in a 30, or 75 in a 60, I'd be very very surprised at that

They were probably hiding in a horse box or in a bin knowing wales :D

I do that run from the Wirral every few months, just switch on the cruise and settle back.

Yes I agree, but that info came from West Midlands Police own website dated 2014.

I suspect, as indicated, each local authority, imposes its own rules as it sees fit, and that these rules change from time to time.

I got a course for doing 74 in a 60 when I got caught a year and a bit ago. And that was right in the middle of the window, I thin it was 72 to 76 or something.

My other half got caught doing 43 in a 30 and told she was *just* over the limit for a SAC but she managed to flutter her eyelashes and get put down for one so the 10% plus 9 sounds around the limit. Saying that it was a few years back now. 

Someone at work got done for doing 44 in a 30 and the cut off for a SAC was 42 so £100 later....
