The RAC told me to put: "I have been in touch with the RAC Legal Services and understand that the problems with this vehicle are all covered under the Consumer Rights Act 2015 specifically "Section 9 - Goods to be of satisfactory quality", "Section 10 - Goods to be fit for particular purpose", and "Section 23 - Right to repair or replacement".

 

Other sections might apply in your case obviously, but if your car went in with a perfectly good diff/haldex and came out with an exploding one that act will cover it because it covers both goods and services.  It'll probably be in Section 39, it's here: https://www.legislation.gov.uk/ukpga/2015/15/contents/enacted

 

I'm almost certain it'll say somewhere that it's the garage's responsibility to show that it wasn't their fault, it's not your responsibility to prove it was unless a certain length of time has passed.  So saying "it's a one off" simply won't hack it.  Ring the experts at the RAC!

 

I have called the RAC Care Legal team and had a  good conversation  with the call centre which is 24x7 btw.

They told me to draft the letter with the intent of legal route, quoting sections 23,10 & 49.

Booked my car in for an independant check/report for Monday.

Just bought my first Yeti today and am keen to get the Haldex oil changed and gauze cleaned.

Is this DIY'able, or best done at a garage for the sake of £100 or so?

Dear Dale,

congrats on your purchase today...I cannot comment.

I would contact DEKRA

for further advice, perhaps an inspection if it's a used  car.

 

Happy motoring, we miss ours at the moment.

If you have just purchased it from a Skoda dealer and it is under Skoda Approved Used Warranty then pay £100 at a Skoda dealer.

My Yeti has been taken off site, the impartial first line investigation costing for £60,which was better explained to me than the main dealer charge of £260 !

 

The rear axle / diff casing has a long crack...The service advisor mentions  if I want to strip this apart and obtain a  forensic report, it would cost more and he said do consider the option of replacement  with a used system  to get your car up and running.

Then pursue  the consumer rights act with the main dealer.

 

 

 

So stop me if I'm missing something here. They charged you £60 to tell you that the diff casing is cracked?

yes...This is the first line, that any garage would perform. The diagnostics and the reports will be from DEKRA in a few days time.

So now we have a report saying diff casing cracked as opposed to haldex unit. 

 

I think it's plainly clear to see what has happened here and wish you the best of luck in a resolution.

Our legal adviser has a letter prepared...I'm lodging a formal complaint as we speak, to the main dealer customer care department.

We have the car ready for the replacement parts with our independant  garage, happy and anxious to get our vehicle back on the road. 

 

Do you think it's a good stance ?

 

Ultimately I think you're going to need a report saying diff damage from lack of oil. 

 

Would be interested in seeing decent pics of the drain plugs for the haldex and the rear diff. I bet the rear diff one will have witness marks showing it has been undone when it shouldn't have done.

What does your invoice have referring to the Servicing of the Haldex.

Was it listed separate for labour from the other servicing done.

Is there the part no. & units for the oil used?

yes it was

  • Carried out Haldex Gear oil change  - SG060175A2
  • Diagnostics of rear washer jet/ replacement of jet nozzle
  • Fuel filter replacement : S3C0127434
  • Brake fluid was on a separate invoice, this could be of my service plan, part: PBF

The problem was this vehicle was towed when there was apparently no oil in the relevant area. That obviously shouldn't have been done. Any reputable compnay, knowing there was a problem with any part of the transmission should have used a flatbed.

4x4 Yeti's can only be towed with all 4 wheels rotating. Nothing to do with transmission wind up. More to do with the way the Haldex system works.

Understood. I made the assumption of transmission wind up as I have a LR Defender that shouldn't be towed by front end lift. Whenever It's had to be taken anywhere I've had it recovered onto the back of the recovery truck.

Dear all,

 

just had a conversation with the main dealer that service my Yeti..They said more or less the Haldex cracked open or split..Stems from the  health of the car from new, if it was routinely service year in year out by changing pollen filter, engine oil checks, brake fluid change...Does this have an adverse effect with the Haldex system.
