what are my rights

Featured Replies

bought a 56 plate 1.9TDi ambiente from local dealer a copuple of months ago going to make my first long journey and look for the cd changer (as shown on my cars details) and its not there. Anyway phone up the garage and all they can offer me is a full tank of petrol but i would have to go to pick it up and its a 70 mile round trip.

They say you cannot relly on their printed details (i have a copy of the original) as they are not accurate. perhaps i am being a stupid female but i thought if a car said it came with something it really should have it.

any ideas greatly appreciated

Sale of goods act?

I would see a solicitor if they fail to fit a cd changer free of charge...

p.s there crap anyhow ;)

Citizens advice bureau first thing Monday morning.

I'm no lawyer, but they've surely already admitted liabilty.

Having said that, a full tank of petrol (less 70 miles) probably costs them more than the CD autochanger anyway.

Weird really.

i dont really want the cd changer as i want a new steroe with the IPOD connector but its the principle of the matter

I'd have a chat to CAB/solicitor to see what your legal position is. If they've offered you a tank of petrol and you don't want the CD changer, then just say you're unable to drive the 70 miles, please can they put the cheque in the post. Other option is to get them to fit the CD player (plus compensate for petrol for the round trip) and then ebay it ;)

What about asking them to do a deal on servicing - like a free one when its next due, that way you gain more than it would cost them. By the way, as the car was second hand any "configuration" that you have assumed from the car's model designation, ie CD player included really goes out the window - and they could try to make out that you "lost" it in the intervening period - if they were put under pressure. All in all maybe a free service when its due (with a written statement agreeing to that - ie proper service as per SUK plan and stamped up) might stop you taking this further or passing the word around that they are "not good to deal with".

I stamp about n moan for ages, get the tank of fuel and not bother going to pick it up! lol Nasty i know but if its meant to be there then it should be....(mini rant now finished....ahhhhhh lol)

It's a used car which should be fit for purpose, which is for transportation. Was it adverstised as having a CD changer, the Ambiente qould probably have had a single CD player as standard not a CD changer. What does it say on tour invoice?

you will find that most dealers use an "automated" system that pulls up specs from a central system. Almost all have issues equally they will have E&OE on the bottom and it is "sold as seen" so unless you bought the car over the web you have little legal recourse. However a stiff letter to the DP threatening to return the car will usually prompt a response. (especially if you took finance as a threat to notify the finance co is the best tool to make a dealer listen.)

As for wanting a change of stereo instead - dont mention this as it weaken your arguement.

i wouldn't get to carried away, that sheet is only an offer to treat, the contract is made on purchase,i know from bitter experience that they don't HAVE to do anything,as you should have checked the car over before you took delivery, however as a goodwill gesture you may be able to get more than a free tank of fuel, the ipod link does not require a new stereo, just a connection lead,so try pushing for a free one:thumbup:

Does this mean since as my c/c, heated seats, pd160 intake were unknown to the dealer i should give them back, haha, only joking :)
