Given that in the op the guy said it was 2 weeks ago and that was 10 days ago, it is all rather academic wether he has 14 days cooling off :rolleyes:

Very interested in this, as we have a similar situation.

We cancelled our Audi order 2 days after placing a £1000 deposit over the phone. We had not signed anything or received anything confirming T&C's. We had been to the showroom a week or so before, but had never seen the car (new from stock) and all negotiations took place over the phone.

When we cancelled the salesman said he would sort the deposit, but then a week later the sales manager wrote to say that the deposit was not refundable.

We took consumer advice which was unclear whether we were protected by Distance Selling Regulations or not - it really is unclear, and we've been told that it's there for the purchase of other goods over the phone or internet, but I don't see why a car should be any different. The other point is that of going to the showroom, even though we never saw the car we were buying and all negotiations took place on the phone/email for that car.

I've read much about how people believe we *should* be covered, but nothing to categotically state that we are.

I'm really disappointed with Audi, how they could keep £1000 (alot to me, but not to them), and create all this bad feeling towards them. Why would I want to deal with them in the future when they've treated us like this. They've not even had the decency to reply to our second later asking again for our deposit and pointing out our consumer rights (which they obviously don't think we have any).

I'd be interested to hear how you got on. We're currently looking to take further legal action. I can't believe we're not covered by any consumer rights to change your mind within a cooling off period.

Your beef is not with Audi.... it's with the bleeding dealership who are NOT owned at all buy Audi. Infact the dealership have to PAY Audi as part of a franshise

Any updates on the OP's case? The lesson is surely – CHECK ALL TERMS AND CONDITIONS CAREFULLY BEFORE HANDING OVER ANY MONEY.

However, I can't see how the Audi dealer has a leg to stand on regarding keeping the deposit, especially in the OPs case :confused: It hasn't exactly made any effort to fulfil its side of the deal so I don't see how the customer could be expected to continue doing business with them. If you haven't signed anything, then surely you haven't agreed to anything? Why doesn't the dealer ask for a signature on an agreement, with the deposit?
