...Got a ticket in the post today for driving in a bus lane, now im not asking to get a way out of paying it cos i hold my hands up. At the time i didnt know the road was a bus/taxi lane as i dont use that area of town very often and its only become one in the last few months. But i was under the impression they only has 2 weeks to send you the ticket?? this happened on the 28th may and i have photo evidence.

so am i right in beliving they only have 2 weeks to contact me or not?

But when I got done it was your fault, you were navigating (radioone) and told me to go down the road,

but I did get off the fine and received my money back after I proved they had it wrong !

Hmm if you were using the bus lane to turn left, or overtake something that was waiting to turn right, the photo would prove nothing.

The penalty notice must state:

(a) the registration mark of the vehicle involved in the alleged contravention;

B) the detection date and the time at which the alleged contravention occurred;

© the reasons why the authority believe that a penalty charge is payable;

(d) the amount of the penalty charge;

(e) that the penalty charge must be paid before the end of the 28 day period;

(f) that if the penalty charge is paid before the end of the period of 14 days beginning with the date of service of the notice, the penalty charge will be reduced by one half.

There is then a load of boring legislation that the council has to comply with to give them to power to issue fines for driving in bus lanes. Get ready it's heavy reading:

You can require them to advise you under which legislation they have imposed the notice, because Paragraph 5 of The Traffic Management Act 2004 (Commencement No. 5 and Transitional Provisions)(England)(Amen dment) Order 2008 has effect to modify section 144(3) of the Transport Act 2000. Due to this modification section 144(3) now advises;

144(3) An authority is an approved local authority if:

(a) an order designating the whole or any part of its area as a civil enforcement area for parking contraventions has been made under paragraph 8(1) of Schedule 8 to the Traffic Management Act 2004, and

B) the relevant national authority has made an order specifying it as an approved local authority for the purposes of this section.

Then there is stuff relating specifically relating to bus lanes:

Paragraph 9(1) of Schedule 8 to the Traffic Management Act 2004 states;

Designation of civil enforcement areas for bus lane contraventions

9(1)The appropriate national authority may make an order designating the whole or part of a local authority’s area as a civil enforcement area for bus lane contraventions.

(2)An area may only be so designated if it is within, or is co-extensive with, an area already designated as a civil enforcement area for parking contraventions. (so if they haven't already complied with section 8, they CANNOT fine you. Ask to see the designation that applies under section 8, I'll bet they are unable to supply this)

(3)An order in force immediately before the commencement of this Part of this Act approving a local authority for the purposes of section 144 of the Transport Act 2000 (c. 38) (civil penalties for bus lane contraventions) has effect on and after the commencement of this Part of this Act as an order under this paragraph designating as a civil enforcement area for bus lane contraventions so much of that authority’s area as is a civil enforcement area for parking contraventions.

(4)References in this Part of this Act to the enforcement authority in relation to bus lane contraventions outside Greater London are to the local authority in whose area the contravention is committed.

Basically you want them to prove they have complied with the legislation, and that they can prove the area in question is designated as a civil enforcement area for bus lane contraventions. If the council has not complied with this legislation you can tell them to stick the ticket where the sun doesn't shine.
