Cancelling My VRS Order

Can anyone give me the legal position should I cancel my order? The facts are as follows:1. On 26 June I ordered a new VRS estate. I traded in my old car which has been sold by the dealer. The dealer holds a sizeable deposit (£2k).2. I was told the car would be delivered in late Sept to early October. This now has been moved back to late December/January 2011. I note my order form shows "TBA" as the estimated delivery date.3. This situation, together with Skoda UK's apparent apathy, has ruined the buying experience for me. I am now considering cancellation. I am so cheesed off with this as I was looking forward so much to having the car being a big Skoda fan.My belief is that Skoda have failed to honour the contract and I can cancel without penalty.Any informed thoughts would be welcome. Thanks a lot.

I would speak to the dealer before I started worrying about it. You can explain your thoughts and if in fact they do threaten you with taking the deposit then you should be able to ask them why they think that that would be a suitable course of action. You probably want to do this in person on a Saturday morning and make sure its where other customers can overhear.

On the other hand be a shame to lose your VRS, they are lovely cars . . . .

If you look on the forums no one is getting their cars in 3 months so that was unrealistic , So you have no car now? I think you would be better to get in touch with customer services at skoda GB and explain how frustrated you are ,and try to get a build date from them .Don`t cut your nose off to spite your face ,5 to six months seems the norm for most makes that are specced to your order. If it makes you feel any better, they got me with the old TBA ploy as well.

now i am struggling to get any kind of date from them.

they have guessed at late dec / early jan but looking at your order date i have no chance.

i didnt order mine until 14th sept.

did you order diesel because the implication is that they are behind with the diesel engines more than petrol.

i notice on this forum that somes guys are getting compensation and/or courtesy cars

As others have said, will be worth it if you can wait. I'm blown away by mine! Fabulous car.

I presume you have access to a car if you need one? If not, I would have thought the dealer should be providing you with one in the circumstance you describe.

I was given a guaranteed future value for my Golf which I was part exchanging. e.g. "The trade in price in of your Golf would be £9750 now, but we'll give you £9000 for it when your car is built in 12 weeks' time. If your car is not built in 12 weeks' time you either continue to run the Golf until we build your Octavia, or we may decide to take your Golf and give you a hire car until your new car is ready".

If they told you three months, then they need to look after you if that period is extended!

If you ordered in Jun I cannot see why you have been given Dec/Jan delivery.

I ordered mine 28th of May and pick up mine tomorrow. White hatch cr diesel with extras.

I would have thought your should be end of Oct or beginning of November unless estates are taking a lot longer.

Just a point to note, my week 36 build did not get confirmed until the Monday of the actual build week so they may just be guessing at present?

ordered mine 19th june and picked it up last saturday. are you sure they didnt forget to order yours? might be worth a call to CS to ask them but its definately worth the wait if you can hang on and maybe get some compo?

Only saying thisi to try help and not to rub it in but ordered mine that week in June and my car is at garage and ready for collection, cant help but thing foul play somewhere prehaps your order has been nicked for some one else or forgotten to be processed by admin staff at dealer?

Again not wanting to add insult to injury but I ordered my petrol estate on 19th June and it was at the dealers 13th Sept. Twelve weeks almost exactly.

IMHO you are justified in asking for a hire car since they have sold your car.

After all they have not given you a new car and are taking benefit from your old car (sold) and your deposit.

I'm not a lawyer though, and because your contract says TBA, I guess it would fall into what's reasonable.

Regarding your possible cancellation, suggest you go to your local CAB first. As well as the TBA on the order form, there could also be a verbal contract in force, ie, any date they orignally advised. They will be able to advise on recovering deposits etc.

Check the days the CAB open, and if it's a drop-in service, turn up early, like about 09.00, and maybe take a book to read while you wait. The adviser might be glad to help with a consumer law enquiry, certainly makes a nice change from desparate debt, bankruptcy and benefits queries..

Another line of enquiry might be Consumer Direct - Trading Standards as was. .

Agree with the others about the wait being worthwhile though. Nice cars...

Thanks guys for input.I have taken some legal advice.......under Sale of Goods Act the garage has to deliver the car within a time that is "reasonable". The difficulty is in defining "reasonable".I will see what Skoda and my dealer have to say in the coming days. They still have not given me a build week/delivery date.Nevertheless, Skoda UK have handled this issue of extended delivery dates abysmally in my view. Is it beyond them to have written to people like me and explained why there is a delay and what the compensation arrangement will be? I am seriously unimpressed. It's a shame because I know the car will be stunningly good.

perhaps you can use the dates which others have given as an indication of what is "reasonable"

Know how you feel - ordered mine (Octy 4x4 1.6CR with extras) on May 19th; was told today build is "provisionally week 45", however nothing confirmed.

Saw a "used" 10 plate Octy 4x4 1.9PD on the Skoda UK site for 17K , with less than 10k on the clock - can't be @rsed waiting any longer and am thinking about telling the dealer where to stick my order.

The main reason is most likley to do with the VAT free offer

I think it is also down to demand for certain engine and body combinations.

I ordered my 1.8 TSi Octavia hatch at the end of june and was told 12-16 weeks.

I picked it up nearly 2 weeks ago now.

When i picked it up i was told it was a 26 week wait.

Similar story my end. Ordered mine 4th June and been told 'you wont see it until the first week of January'

Really **it customer service from the dealer and got the old ' we'll compensate you when you take delivery'

I also agree with the other posters, it WILL be worth the wait, but like you I'm struggling to get my head round the Skoda phrase ' We manufacture Happy Drivers'

My Octy II took nearly 5 months to come, but it did hit the Christmas break which didn’t help. When I was selling cars I often found that the expected delivery date would move backwards (the customer would then be very annoyed) and all of a sudden come forwards again (the customer still pretended to be annoyed, but you could tell they were pleased). Does VAT go up again in January. Could be quite expensive if you don’t pay for it before then :(

Latest on this saga is as follows:

1. Contacted Skoda again today. I my view they don't know whether they are coming or going. I have no confirmed build week but a possible week 46 (Nov 15). So they can't tell me when I will get my car...........just a bit of drivel about £150 goodwill gesture (big deal).

2. I stated that if the car came in December I would want registration delayed until January so it is a 2011 car. I was told this was not possible and would have to pay the VAT. I know this is complete rubbish but just another source of irritation. They make me wait about 25 weeks instead of 12 for my car and then try to dictate when I take delivery. Shocking customer service.

3. My local dealer is understanding and trying to assist, but I fear the worst.

4. I was cheesed off with this last week. It just gets worse. I am not a "Happy Driver".

I can understand your frustration with all this but can not see the reason to delay collection if you could get it in December. Having a car registered Dec 2010 will be no different come resale than one registered Jan 2011. Now if you delayed to get a newer reg then this would have an impact. May as well get it as soon as possible and start enjoying it.

I would bet this is the reason for your delay:

My Superb CR140 DSG was ordered the same week as your vRS and I have a provisional build week 43. My understanding is that high DSG demand is negatively effecting lead-times across the whole Volkswagen group. I can understand your frustration if you are car-less in the meantime.

If the car is ordered and paid for in advance of the VAT increase you pay the old rate I believe. In theory at least the car could be paid for in December and registered in January. Its the exchange of payment rather than goods which matters. It may be difficult to convince SUK and the dealer though....VAT rate changes don't happen every week!

I asked for mine, as once the order is on the system & a number generated the dealer can tell you the scheduled build week, & even a confirmed scheduled build week.

A dealer or even SUK quoting TBA sounds complete bullox, even suggests that the order is not on the system if they cannot even tell you the build date allocated by the system.( even if date changes as mine has twice the dealer was up front & told me )

In answer to the above.

I was not given a build week or ref number at the time of ordering. My order form shows TBA for estimated delivery. I was verbally advised end Sept/start Oct.

Yesterday I was shown my car on the system. Build week 46 is provisional and can be subject to change. No one can tell me, with certainty, when my car will arrive.

My problem with all of this is not the delay so much as Skoda UK's arrogance and lak of customer care.
