If you have a look on XDA Developers you can find the article that started all of this and the letter the guy got from Carrier IQ and the response from the EFF and eventual apology from Carrier IQ.

My phone isn't rooted so I can't check mine unfortunately.

The title is misleading is doesn't tell you.

The roster of confirmed smartphone manufacturers and network providers using the controversial Carrier IQ tracking software has grown to include Apple, AT&T, Sprint, HTC, and Samsung. Verizon, Nokia, and Research in Motion, meanwhile, have denied reports saying they employ it.

I'm still none the wiser what to look for.

In the UK depending on what is actually recorded and sent it could be a breach of the DPA. Not sure who would be liable. Carriers or manufacturers.

Depends. On a branded phone, I would say carriers. They have the firmware in their labs to add their own branding/themes/bundled software, so they should remove things like this at the same time. On a "virgin" phone then the manufacturer.

A Q&A session on the Register today, they basically admit they take the data, but claim it is OK because they dont look at it.

I am just off to steal 50,000 eBooks from Amazon that I promise not to read.

And the mobile service providers know this is going on.

Surely, they are consequentially liable for any breach of confidentiality as they facilitated it.

Class actions are in process over the pond already I believe. For once, I can't really say I blame them!
