Ouch!

Was she definitely on the phone? Did you see her did she admit it?

Police involved I assume?

Yeah she admitted it, I had the assessor round already and he said new bumper and exhaust, respray boot too

I spoke to the woman and I asked if she was ok, she said the reason she was on her phone was because her husbands in hospital with cancer. I felt so bad for her :(

On the phone = Illegal, simple as.

Yes, her situation may be bad (and it is human to feel sympathy) but FFS, her mind was obviously not on the road at all.

What if that was a child instead of your Fabia?

I'd throw the freaking book at her.

Were you on your handbrake or footbrake?

My reason for asking, my wife was sat waiting at traffic lights on an uphill section of road, so no rear brake lights showing, bang another woman straight in the back with similar damage.

Since then I have connected the brake lights to come on with the handbrake, much safer.

Surely you'll just flatten the battery when it's off?

Sorry bud, but this is not safer at all. All you are doing is dazzling the car behind, permanently.. One of my pet hates.

It also errs on the side of illegal, as it is in contravention of the highway code:

Waits for the comments...

Ideal for burning people's eyes out when in stationary traffic. :giggle:

edit: Damn, too late.

Mwhaa haa haa

Aw gutted for you judge really am, hope it all goes quick and straight forward for you. Lucky you didnt crease the boot lining etc.

So we'll call it, £60 + 3 points for being on the phone, Driving without due care and attention, that must be 3 points + £100, perhaps £150

Anything else

Expensive Phone call

At least it hasent been written off. There is too many melts on the road these days. Same thing happened to my neighbour. Got their mint triumph herald written off.

It's the points that would worry me more.

Nice insurance increase too, they hate phone convictions more than speeding when working out your future premiums.

But in the same position as the OP the first thing I'd have done is copied the rear drive recorder footage for the police.

She was clearly not concentrating and using a phone. Could have killed someone just because she didn't want to stop to take a call. Stupid.

Ouch, the damage could have been worse though. How much is a bumper respray for the rear? Mine needs doing aswell as it has a small mark from where the previous owner reversed into a pallet lol.

While I feel for you, I hope you can see the irony in your sig?

Hopefully she won't change her mind on the at fault bit. If she does though, I got a bumper for my Polo for £20 in the summer, so not the end of world if you have to go it alone (although on principle I'd make sure she pays!).

Yep, and you can pick up a bluetooth handsfree for £15 nowadays. I've got loads hanging around here there and everywhere.

Even worse I'll bet they were in one of those s****y new cars with inbuilt bluetooth - there's just no excuse for having no brains to read the manual and press a few buttons. (Sorry won't bite with the gender card here, men and women are both as bad, lol).

How many points and a fine for what could have been Manslaughter

Glad no one was hurt, I had v similar situation on Sunday, lucky it was lower speed and I had clutch down and lightly on brakes so the car shunted forward. No damage was done so I left it as that. Yes it was a woman.

I'd be interested in the handbrake light though, perhaps just make the top one come on? Technically that's not a legal requirement so I assume it's ok for it to come on whenever in theory... Lol

Oh and dazzle? What about people who drive autos? Lol logic fail :p

People who drive autos can just put their handbrake on exactly the same as a manual driver, and optionally put their transmission into neutral or park (although I'm 99% sure this isn't necessary since in an old-style manual the liquid coupling will cope with the handbrake and in DSG I'm assuming the clutch is automatically disengaged when the handbrake is on).

edit - never mind, I totally missed the comment above about wiring the handbrake to the brake lights, and thought you were just on about sitting with your footbrake on. I'll get back in my box ;)

I recognise that punto parked next to you... The stormtrooper...

I sometimes apply my brakes aswell as my handbrake at traffic lights....the handbrake on these isn't that good IMO

Really? Mine's fine. Speak to yer mechanic and get them to tighten it up, the handbrake on the Polo was ****e until mechanic picked up on it at service.

Try pressing the brake pedal hard, and pulling the handbrake on hard a few times.

It's common, on the drum brakes, for the self-adjusting mechanism to not work well - sometimes necessitating manual adjustment.

Pull handbrake while foot brakes applied, always gave a much stronger bite on my Ibiza.

Hope it gets fixed up back good as new mate :)
