In order to open the tailgate I have to push it down slightly when I push the release button. Is this normal as I find it really annoying? Had a look at the latch mechanism to see if it could be adjusted but its appears not :(

Maybe move the latch on the boot further away from the lock. Or try and adjust the locking bit itself.

How does it adjust? I took the cover off but couldn't see anything obvious as to how it can be moved

Are there not two spline bolts holding the latch down?

Yes, but I couldn't tell if they allow any movement. I'll have another look in daylight

There is an amount of movement usually.

Best thing I did, remove plastic trim around latch and the circular part underneath is what pushes boot up I'm guessing. Sprayed it with wd pressed it a few times and my boot would function like normal
