ohh there another story recently knocking around of busses blocking trams thought it was the same one  :D

 

police will probably want to speak to the driver let alone his employer  :thumbdown:

It's annoying enough when someone does it blocking my car, never mind a bloody train! 

i don't get why anyone would block ANY junction or driveway or anything its just uncalled for.

Driving into work this morning along the same stretch of road, deja vu!

 

This time the bus in front didn't stop / give way and happily passed the bus coming the other way on the S bend.

 

Slow and steady but plenty of room to spare.

 

I should point out that I didn't try to pass it this time either :D

No word of a lie, the guy actually driving this one could easily be the guy who I ended up having a friendly chat with. It's even on the same route!!

The forward facing camera mounted on the dash under the ticket machine is in prime position for catching my smiling face!

When I rang up to complain on the day of the incident (Monday) the lady on the phone who took my details explained that it would take up to 10 days for them to examine the complaint and get back to me.

 

I did ask if it would be possible to see the footage which promted her to mention they only normally release it to the Police.

 

Not knowing the accurate facts I mentioned that I should be able to at least view it under the Freedom of Information Act (not knowing if this was true) and she said she would mention it on the complaint form.

 

This prompted my post on here. I'll ask again when they get in touch, likely to be the back end of next week.

I was thinkin that isn't it only if it's government based ?

Data Protection Act is the one you're after, as that's for private companies.

FoI Act applies to most Public Bodies, from Government Depts to local Councils. The bus company in this case is a private company and it does not apply to them.

 

Data Protection Act legislates how info is kept and who can see it. You could not ask to see the video under the DPA.

Straight to the point as ever, don't beat around the bush :D

You have no right to see the video but in your WRITTEN complaint to the company request that a senior manager of the driver views the footage. (state time, date and vehicle).

Remember we all have off days and hopefully this is a one off for the driver but if a regular occurrence then the company should consider re training, monitoring or more formal disciplinary action against the driver.

However you must also be prepared for them to view the footage and say you were in the wrong (as you admitted) but fail to mention the driver's inappropriate behaviour. 

 

As stated WRITE your complaint, send by recorded or special delivery if you are serious.

Their protocol is to put the driver in driving school for a day but from how you explained it he didn't do anything wrong to do with his driving no where els he could have gone so he turned the engine off in defiance. It's probably what he said that was unwarranted .

No update yet as I'm still waiting to hear back. 10 days is the middle of next week.

 

I'm not in a position to question the standard of his driving however from where I was sat he was using his vehicle to bully me.

 

Remember he mentioned to me that he didn't want to cause discomfort to his passengers? Well when I was reversing out of his way he quickly started his engine and followed me back inch-by-inch, on the brakes, off the brakes, back on the brakes, back off the brakes, maintaining a steady three inches between my front bumper with a his of air brakes for every neck snapping release of the brakes. Passenger comfort a priority? Clearly not when he has a point to prove and prefers to use the size of his vehicle to force home that point.

Braking from 15-20mph to a stop quickly and inching forwards are two different things. If I was causing discomfort to my passengers but inching the bus through traffic I dont think anyone elderly, frail or disabled would get on the bus and I'd certainly be having time off work with a bad neck.

 

The blokes a class A bellend no doubt but inching forwards isnt going to break his passengers neck or give them whiplash. That obviously doesnt make him pushing you out the way any better.

Just a quick update, got a call from Arriva late last week. The lady on the phone told me I could have a copy of the CCTV for £10.

 

I then asked if she'd had any feedback from the local depot regarding the driver loosing his temper. She said there was nothing on the report and would go back and investigate.

 

In the meantime I got this email from the local council...

 

 

Dear Mr XXX

 

CCU 38109997 – Arlington Way, Durhamgate

 

Following your complaint received on 29 September 2014, a Stage 1 investigation has been completed and the following response has been received from the service area concerned:

 

As you may be aware the development of Durhamgate is currently one of the most significant regeneration opportunities in the north east of England and expects to generate close to 3,000 jobs when complete. In order to facilitate the mixed use of the site the highway layout was always planned in such a way to segregate residential, commercial and industrial traffic.

 

Within the overall road layout it is intended that the residential traffic would use Enterprise Way, commercial traffic will access the development via the new “boulevard” onto Thinford Roundabout and industrial traffic will use York Hill Road.

 

In order to deter industrial traffic using the new roads through Durhamgate a weight restriction has been introduced together with the “s-bend” to which you refer. The combination of the legal restriction and physical layout has generally meant that the amount of industrial traffic accessing through the Durhamgate site has been kept to a minimum.

 

Prior to the road being opened to general traffic, trials were undertaken with the bus companies to ensure that two buses could pass safely. Indeed the centre-line road marking was offset to assist drivers undertaking this manoeuvre.

 

It may be that bus drivers are simply being over cautious and stopping in the road, however as you state this could have an unintended consequence of potentially inviting other road users to overtake. We will ensure that this issue is brought to the attention of the bus company involved so that drivers do not stop at this location.

Jesus, I wish our routes had enough time I could stop for no reason, I also wish our council would consult us on road design :D Very strange.
