Car not as described, multiple faults...refund?

.......and now he's sending messages listing all the faults Ive mentioned and telling me how I'm wrong, in a nice aggressive abusive manner. Up to 5 messages so far...........make that 6!

Funny really, had to chase him the whole way from initial purchase enquiry until now. Yet now he sends more texts and photos than Ive received in 3 weeks!

Worth a trip. If it wasn't faulty and he was confident of that fact, he would say "your car is sat here come and get it". If he is offering refund but trying to claw back some money whilst being aggressive to a customer he is just a chancer IMO. 

 

Buy private and take your Skoda mate with you would be ideal way to buy another.

£3.1k for the car. 2006, 120k. I can understand wear and tear, but when its described as "excellent" and "immaculate" I also expect almost showroom condition. Even if it was described as "very Good" you would expect everything to work! How you can claim a car is excellent and immaculate and have 5 or 6 faults at the same time is beyond me..

It doesn't matter what he thought. If what you say is true, then the dealer misrepresented the car. In law, a layman is not expected to be an expert.

After about 8 calls he finally rang back.

Said nothings wrong with the car, told me i'm making it up and called me an idiot that doesn't know what i'm doing and have just plugged a machine in and read off codes. When in fact it was one of the members on here experienced in VCDS. Rear wiper fault he ignored. As for the handbrake he says its fine even though i can feel its not and my skoda mechanic says its not. And now wants to charge me for picking the car up as it had no faults (even though he says the air con needs topping up........yet also says it works fine.....low pressure warning in VCDS so cant be working!).

Can anyone vouch for Air Volk Motors in blackwood, wales? Thats where he sent it for diagnostics, just want to know if they are any good.

As for the lights keep going off and on, he blames a bulb wasnt plugged in and rolling loose, I know for a fact all the bulbs were in and it was an old blown bulb rolling loose. Also told me its only a rear right fog light, yet refused to accept or understand that the left hand side had been enabled in VCDS. And whenever i tried to counter his claims he just shouted over me till i shutup.

Needless to say I've asked for my money back...........though he wants to charge me for diagnostics and him collecting the car to take back. So reckon ill loose out on £300. but better than being stuck with that heap of ......

Still wondering if its worth a trip to CAB about it all.

Managed to contact the garage the dealer sent it to. Said he deleted the codes but some still remained (not what the dealer said). Was also told he was never asked to check the handbrake!
Also said turbos either work or go bang, nothing in between.........sounds a bit like a twist on the truth to me! All he did was boost test. Didnt check for vane damage etc, i could have told him boost was fine, its the siren noise i want gone.
Funniest bit was when he said he cant do software on the cars, so surely that means he couldn't diagnose the faults fully anyway.

Rang CAB who suggest filing for misrepresentation + breach of contract. So think that's the way this is going!

Well you can not expect them to remove the Turbo to inspect it for wear on an 8 year old car.

 

Can indeed expect that if your not the one paying the bill :D

He never did ring, asked for invoices of work (so i can pay and get my money back) he pretty much tells me to **** off and threatens legal action. Any way to contact trading standards/free legal advice without CAB (who seem to be faffing).

What is it you are after here?

 

The dealer now has your £3,100 and the car.

 

He doesn't want to give you your money back, he'd rather you had the car.

 

If he does agree to a partial refund then it's going to be exactly that - partial. He can now claim he is out of pocket after collecting the car from you and having a third party perform an independent check of the vehicle.

 

Independent advice is an option, but expensive, and now difficult as he has the car.

 

Legal action is possible but don't under estimate the time, effort, stress and potential costs involved. You'll also be without the car or your money for months.

 

The only way to minimise your losses now is to go and collect the car, put it down to experience and look to get the relatively minor faults fixed locally.

But i cant sell it on in that condition and i wouldn't be happy to drive it. I now cant afford the insurance after having to do temporary re-insures on mine anyway.
I'd already agreed with him on the phone for refund minus the diagnostics etc. hence why I asked for the invoices so I knew what to pay. But apparently they are none of my business, how can I agree to a refund price with no proof of costs?

Because he doesn't want to refund you. He's stalling, making life difficult, hoping you'll give in.

 

He now holds most of the cards (the money and the car).

 

If he does eventually refund you it's not going to be anywhere near the amount you paid him, in which case keeping the car would be more cost effective.

 

You were happy to buy the car, so assuming the faults are fixed then you'd be happy to keep it? None of the faults listed make the car unsafe in my opinion.

 

Even if you decided to sell the car on your going to be out of pocket, you've paid dealer prices and will be either selling privately or part exchanging.

 

You have to make a choice, continue to pester the guy for a partial refund (likely to be much lower than the £300 you have suggested), pursue the guy through the courts or go and collect the car.

 

Would you rather have the car in it's current condition or take a £500 loss on it? I imagine you'll be able to get most if not all of the faults fixed for £500.

Just a quick question, did you test drive it? There are numerous faults in there that surely should have been obvious from the outset and obvious from testing the vehicle fully. Unless i'm buying a shopping cart that can be fixed for whatever is in my pocket I go through the car like a knife through butter.

 

 Depends on how you paid for the car, if you've bought on a credit card the companies can be powerful allies in getting what you want. Otherwise dig in because it'll be a long, hard fight.

Saw this and had to laugh, got a text message today saying he can't pick up the car tomorrow!! No reasons why, and has asked for tuesday instead. Have let him know I will not have a car from sunday (insurance runs out) so needs to be repaired and returned or refunded by that date....sound fair??

The instrument cluster fault is quite common and doesn't mean the cluster is actually faulty

Most cars will have faults even new ones, the time to worry is when things don't work.

Dealer tells you about faults he knows about and you buy the car  -  your fault

 

Dealer doesn't tell you about faults he knows about and you buy the car - his fault
