Car not as described, multiple faults...refund?

Bought a car 7 days ago Decribed as "exceptionally clean condition" and "Mechanically it drives absolutely faultless".

7 days later, the list of faults so far:

Police siren noise
Faulty instrument control module
Power steering control module & Steering angle sensor Faulty
Instrument control module faulty (which i believe is causing my bulbs to blow/change which ones are "blown" every journey)
Air con not working
Handbrake stiff and binding (stretched/seized cable by the feel of things)


Can I just confirm that I'm perfectly in my rights to ask for a refund? Bear in mind I had to travel about 250miles to collect so had to go mainly on his description.
Oh and the best part of that.... "The interior as you can see is in beautiful condition ..the cream leather is in amazing condition and everything looks and smells lovely and fresh and is a pleasure to go anywhere in"

Apart from the whole thing stinking of smoke! (covered up well by air freshner on day of collection). Went through about 30 dash wipes, all which came out black. Even almost knackered the steam cleaner on the carpet.

So just to confirm, I need to know if I can expect a full refund as item is not as described and faulty. And with the steering module fault coming up under steering and abs, probably not safe either!

Trade. Though he says its a mechanical warranty (so 90% of faults wouldn't be covered).

Methinks he's bull****ted too much. You should "have him" on ad description or if it can't reasonably be driven safely and reliably.

If the car was described to you as having no faults then you can INSIST that the dealer sorts this out at no cost to you at all. Dealers are required by law to accurately describe a car's condition. Also, they are required to supply a car free of defects. You have the stautory right under Sale of Goods Act to have the vehicle repaired at no cost to you, a refund or a replacement. Nothing a dealer puts in a contract can remove these rights.

 

Supplying a vehicle with a non functioning or faulty hand brake is a crminal offence under the Road Traffic Act 1988 Section 75.

 

If the dealer has failed to accurately describe the car to you, either verbally or in writing, and was aware of the defects (ask to see the job card and PDI notes) then this is fraudulent misrepresentation as covered by the Misrepresentation Act 1967, for example he told you the aircon worked and it doesn't, and you are entitled to a refund and damages.

 

If you get no sense out of the dealer, first talk to Trading Standards. Then go and see a lawyer, forget about Citizens Advice. If a lawyer's letter doesn't do the trick, take them to court, they will not want to defend a court case that includes reference to thier fraudulent misrepresentation or RTA offences and they will comply and not go to court, unless of course they are complete idiots. Do not let them tell you "you can't do this" or "can't do that".

 

However, if you threaten with something, make sure you carry it out. The first empty threat you make it's game over and they will then just ignore you.

He has agreed to pick it up and take it away for a diagnostic scan (Along with my VCDS scan results) to see what he can do. Will keep you all posted, hasn't offered a refund yet!

I found some info there for another subject, it's advice to the motor trade so gives you a different perspective.

 

With this you might have a case for misrepresentation of a product.

 

If nothing else you'll have some lingo to put the willies up the dealer.

He has agreed to pick it up and take it away for a diagnostic scan (Along with my VCDS scan results) to see what he can do. Will keep you all posted, hasn't offered a refund yet!

He doesn't have to offer a refund. If he doesn't correct the defects in a reasonable time, YOU have the right to a refund. It's not the dealers decision. Make sure they give you a courtesy car. Don't accept any BS excuse and make it clear you know your rights.

Saw this and had to laugh, got a text message today saying he can't pick up the car tomorrow!! No reasons why, and has asked for tuesday instead. Have let him know I will not have a car from sunday (insurance runs out) so needs to be repaired and returned or refunded by that date....sound fair??

If I were you, I'd be looking for a full refund plus any expense you have incurred as a direct result of the faults in the vehicle or the dealer's actions.

Bought a car 7 days ago Decribed as "exceptionally clean condition" and "Mechanically it drives absolutely faultless".

7 days later, the list of faults so far:

Police siren noise

Faulty instrument control module

Power steering control module & Steering angle sensor Faulty

Instrument control module faulty (which i believe is causing my bulbs to blow/change which ones are "blown" every journey)

Air con not working

Handbrake stiff and binding (stretched/seized cable by the feel of things)

I would say that there are some items here that need fixing but some things that you have pointed out on your scan may not be a reason.

Such as the steering control module and angle sensor faulty, Is there actually a fault or are you just going on the scan.

 

The other thing is we don't know many details about the car or what you paid for the car.

At 128,000 miles it is not going to be perfect and you should expect some minor faults.

On the first part, it does feel..odd at times, has a habit of tramlining and when turning to change lanes on motorways seems to want to not let me turn straight again! That and the ESP turns off with a quick press but have to hold and wait an eternity to switch it back on, pretty sure ASR and all other skodas ive been in are the opposite way round.

And at 128k i expect the odd worn looking switch or handle, but when its described as excellent condition i expect it all to be working!! My car with 115k has everything working, just wear to the silver on the gear lever and a small .5mm chip out of the paint on the window switch, which to me means very good to great condition, so to describe it as excellent is pushing it somewhat. My 28 year old ford capri had less faults, and that was off the road for 10 years before i bought it and sold as seen/restoration.

Right, he finally turned up just over 3 hours late today, and has taken it back to get it looked at. Hopefully I'll have an answer before the end of the week!

UPDATE:

Rang today to see progress. His words were "we deleted the fault codes and now its all fine" ..........I did that when I scanned it and funnily enough, they come back!
No fault on the turbo, so he's trying to give me the privilege of paying for the labour on getting it dismantled and tested.
For the Instrument control module fault he's sent off the dash......not quite sure that's the right method but there we go. Still no comment on things like the rear wiper or the handbrake. When mentioning other faults like the speaker and seat memory his reply was "its a 10 year old car what do you expect".............funnily enough its 8.5 years old and I expect a car in excellent condition as was in the description! Got a funny feeling I've got a bit of a fight on my hands.

Call trading standards - or whatever they are called now. They were really helpful when I had issues with my Ford.

£3.1k for the car. 2006, 120k. I can understand wear and tear, but when its described as "excellent" and "immaculate" I also expect almost showroom condition. Even if it was described as "very Good" you would expect everything to work! How you can claim a car is excellent and immaculate and have 5 or 6 faults at the same time is beyond me..

Sorry, but I think your expectations are a bit unrealistic.

Ive bought 2 or 3 8 year old cars described as excellent, and they have been almost showroom condition. If he had said excellent condition for age then I can let a few bits slide, but he keeps stating its pretty much perfect. If he says excellent and that mileage, id expect it to be equivalent to a car with 40-50k on it. if he said average, then id expect it to be the condition of an average 120k car. Every other car ive bought (for myself or others) has been as described and matched or beaten my expectations. No unrealistic aspirations at all, maybe you should be expecting more for your money ;)

When I saw the mileage in the VCDS scan I thought this too, but the list of faults is long and it sounds like the OP didn't get the car he was expecting so I think he does have a grievance. I do hope he gets it resolved or his money back.

Exactly. When I bought my first car, it was a 21 year old Ford Capri sold as spares or repairs and not been on the road in 10 years. That has LESS faults and was in BETTER condition than this octavia, and was described and "reasonably good". All it needed was rear brake shoes/cylinders. On that basis, this car should have been described as average condition at best.

Well I think your expecting a bit much. an 8 year old car with over 120k on the clock is very unlikely to be near showroom unless you are paying top money.

I don't think that the faults you have listed would be considered major faults either unless there is a major problem with the steering or brakes.

 

I hope you get the issues sorted but don't hold much chance of a refund.

Tried to ring today to get an update...no answer. So sent a text, this was around 11am. 6:30pm I get a reply saying "ring you later"............nothing as yet, and no answer on his phone, straight to answer machine!
Insurance has ran out on the other car and don't have the cash to plow into keep putting temporary insurance on it. Told him the deadline 2 weeks ago when I reported the faults. So now have no car and a 150mile trip to do wednesday........looks like ill be on foot!

After about 8 calls he finally rang back.

Said nothings wrong with the car, told me i'm making it up and called me an idiot that doesn't know what i'm doing and have just plugged a machine in and read off codes. When in fact it was one of the members on here experienced in VCDS. Rear wiper fault he ignored. As for the handbrake he says its fine even though i can feel its not and my skoda mechanic says its not. And now wants to charge me for picking the car up as it had no faults (even though he says the air con needs topping up........yet also says it works fine.....low pressure warning in VCDS so cant be working!).

Can anyone vouch for Air Volk Motors in blackwood, wales? Thats where he sent it for diagnostics, just want to know if they are any good.

As for the lights keep going off and on, he blames a bulb wasnt plugged in and rolling loose, I know for a fact all the bulbs were in and it was an old blown bulb rolling loose. Also told me its only a rear right fog light, yet refused to accept or understand that the left hand side had been enabled in VCDS. And whenever i tried to counter his claims he just shouted over me till i shutup.

Needless to say I've asked for my money back...........though he wants to charge me for diagnostics and him collecting the car to take back. So reckon ill loose out on £300. but better than being stuck with that heap of ......

Still wondering if its worth a trip to CAB about it all.
