I need some advice - I am having major problems with my Octavia!!!

That sounds to me like they are trying to get it working then back out of offering a refund.

I would not allow them to have the car again until they are providing you with a replacement or full refund

Ooops I have just handed it back to them on Saturday. I have kept the Log book and Service History and advised them that I will keep both until I receive confirmation of receipt of the car and agreement of replacement car or refund. Any other input from anyone please?

I have sent them a Special Delivery Letter today stating that I wanted an official letter verifying that they had received the car before I return the log book etc. I also asked if they could go to a certain seller I suggested and gave that sellers details. The Manager said that he would get back to me tomorrow.

Right here we go...phoned me today and stated that car was now okay...no problems at all!!! Guess what came next? Can you take it back for a few weeks and see how it goes then if its not okay I will get a refund! I said no way I do not want the car back under any circumstances. He said he was going to get back to me. I was gutted all the way home.

Got a call just now as a good will gesture they will exchange the car but no refund as the returned Octavia is in working order. I said okay (for now)...listen guys he asked if there was any other car I was interested in...I really want the Octavia but I can't spend the rest of my life waiting for them to source one.

Any ideas I was thinking an VW Bora V64Motion...I would like relatively powerful, 4WD and practical any ideas?

By the way 'Podwin' the guys selling his Skoda (would not accept as modified) is a really nice chap who I spoke to a few times over the last few day about his car we were just mentioning how nice everyone seems to be on this site compared to other forums. If I had the refund i would have defo bought his car...thanks for all the time and hassle mate.

Why not ask them what they have done to the car to correct all the faults and who did the work.

Yep Denis it has not been a very fun experience to say the least!!!

It's very much time for a solicitor here.

How long have you had the car , and how long after purchase did the problems start?

How many times have repairs been attempted etc.

This is all the sort of stuff that they will want to know.

Got it all they have stated as a goodwill gesture (?!!!) they will give me an exchange car (as they agreed before?). They did mention if there any other make or model I was interested in. I was thinking of a VW Bora V64Motion or something like the Skoda Turbo and 4X4...any ideas.

Now today the Customer Services woman says..."take the car back and use it until we get you an exchange to stop you having to use your wifes car"...yeah right then you can tell me no problems at the moment so no exchange. I replied no thanks I'll just wait for the exchange car.

There's an estate on Ebay at the moment (item number 4589797054 ) , but I'd suggest giving them a written deadline to find you a replacement or you will expect a full refund.

They have obviously accepted that the car is not of a suitable standard or they wouldn't offer an exchange , so you are not unreasonable in wanting a working car or the money back which you have paid

I have given them 28 days of receipt of my first letter. Thanks for the advice Doc.

Perhaps a slightly older A4 1.8T?

Or maybe a Volvo T5?

How about an older Skoda + cash?

Thanks guys...I am very keen on the Octavia. It would be a real shame if I had to settle for another car.

UPDATE...I attended the Car Supernarket today to be fair and look at some other cars. The only one anywhere near in the price range was a 2.0L VW Passat. I am not 100% keen on the Passat.

I spoke to the Manager who said that a V64Motion would be well out of my price range. He suggested a Bora/Passat 1.8T...I would rather have a 4X4 but would possibly settle for those.

CAN ANYONE PLEASE SUGGEST websites other than 'Autotrader', 'Briskoda' (of course!) and 'Pistonheads.com' where these guys could source a OCTAVIA 1.8T 4x4 ELEGANCE 2002 AROUND 30,000 MILES for me. I really want a Hatch SILVER, BLACK, DARK BLUE or something reasonable. Please help guys because I really want an Octavia...even the wife is missing the car!!!

Suprise, suprise got a letter from the Car Supermarket confirming receipt of my letters and stating that I will not be getting any exchange car. The car is okay and as they have nowhere to store they want me to take it back! The letter is dated 19th November 2005 and I spoke to the Manager face to face on Sunday 21st November after being accomodating and looking for an alternative car on their site (there were not any in my budget!). He was saying what about trying to get a 1.8t Bora or Passat. I said that would be okay and he said that he would keep trying. He was lying to me all the time! Yes he has signed this letter...I have sent an e-mail to 'Auto Express' I think it may be time to Name and Shame.

Any advice anyone?

Definately time for solictors involvement. Get them to write a responce to that letter threatening legal action.

Thanks for that but I had a chat with Trading Standards and they stated that as the Law is the agreement has to be mutual and if not you can either take the car back with condition that if there are any other faults you will totally reject the car and expect a exchange, refund or refer the matter to the 'County Court'. Or just take Legal Action which could take months for it to go to Court and in the mean time I am 'carless' (Well using SWMBO car which frankly she needs) and I may still lose in Court then be stuck with these rip off merchants until the (so called) 'Warranty' runs out. I will just have to cut my losses and get on with life but I will Name and Shame as far and wide as I can...can I legally do that?
