Caught speeding

I have just had through the notice of intended prosecution.

It was by a mobile speed camera/van and doing 46 on a 30 dual carriage way.

 

Whats the procedure once I send back the NIP saying it was me driving?

 

I know its too much for a speed awareness course but is it likely to be a fine and points or a ban?

 

Once the letter goes back what happens next?

Fine and points. 30 over gets you a ban.

Thats not so bad I was bricking it over a ban.

 

We were on the way to the cemetery and my mind was elsewhere.

 

Any idea of how much of a fine? £100ish?

Most likely too high for a course (43 is the cut off I think) so yeah, a fine £100, and 3 points. Over 50mph would have been a summons so not far off! Thank your lucky stars.  :thumbup:

Complete the Sec 172 notice, then you should be sent a conditional offer fixed penalty

The conditional offer has to be paid within 28 days, make sure it's sent in in good time, if it's received outside they can return it to you and you'll end up being summoned to court which will incur prosecution costs and a victim surcharge in addition to any fine imposed

The fixed penalty guarantees you 3 points, if it goes to court the magistrates heve a discretion to impose between 3 and 6 points

You may also be asked to send your driving licence with the fixed penalty payment, if you are make sure you do, otherwise it may be returned again leading to a summons

My brother knows this only too well now, he could have taken a day on a course costing him less than £100 but instead he got £450 fine and 5 points :D

look into this with more detail!

 

you have the right to know that the instrument that caught you speeding has been calibrated and in perfect working order to ensure the reading is correct

 

if the police or private company can not provide an up to date calibration certificate for the device that registered your speed it will be thrown out of court but it is down to you to request this certificate

I know, I wasn't having a pop at you, but you can guarantee someone will pop up with a comment how to wriggle

It's always nice to see people prepared to accept they've done wrong instead of wastefully stretching resources on trying to get out of it

I take it that you have no previous points by the fact you're asking in the first place

In which case, accept the fixed penalty and you'll get a fixed 3 points

You can't even be considered for disqualification unless the case goes to court, so avoid that and you've got no problem

Extremely unlikely you'd get a ban.

Your insurer  / broker charging when you can to let them know and they change your Schedule and up the cost of cover then 

or at renewal is another hit,

then the next year, and the next.

 

Then if you get a 2nd NIP it starts getting costly and changes many's attitude to speeds on any stretch of road...

From what I've been told and seen myself, it's the one thing insurers are actually pretty fair about as long as it's just one or two tickets.

If you can't do the time, don't do the crime. That's not me being preachy, personally, I'm well over due another one, I've now got a clean licence for the first time since I was 16.
