How many points for this?

Featured Replies

Anyone got any ideas how many points/how big a fine a mate of mine can expect for this??

He paid cash for his annual insurance premium and has a receipt to prove payment. However, they never received proof of No-Claims Bonus entitlement, so his policy was cancelled without any notification or contact or attempt to refund paid premium.

He got stopped the other day as his reg number came up on the police computer as an uninsured vehicle.

Poor b

I had a similar problem, although mine was to do with cover notes

I pleaded guilty and still got 8points & 385 fine.

How did he pay cash?

Did they send him a copy of his policy? I always make them fax/email me a copy of the policy straight away, or a cover note, when I take it out.

If he has a receipt for the payment and either a copy of the policy/covernote or a copy of the quote in effect, that they sent him (so he knows how much to pay and what they are selling him), then he has good grounds to defend himself in court. If the court goes against him, then he has good grounds to bring a suit up against them. Course, if he has nothing to show for it then not a lot.

Fine used to be about £150 iirc. Dunno about points.

So in the case orf your "friend" ;) 7points + 8points = ban :thumbdwn:

technically driving with no insurance is an automatic ban unless you can prove mitigating circumstances.

Well I know he got a receipt for the cash payment and I'm sure he said some other document, which presumably must have been a cover note or certificate, but I can't remember at the moment.

@Goochie: I don't have 7 points (yet) and certainly couldn't afford to pay £700 in cash in one go!

Did he buy the insurance at his local street market or something !?

This is definitely the sort of thing that he needs to speak to a solicitor about.

Given the potential consequences of a driving ban it's money well spent

Law on the Web quotes 6-8 points, a fine of up to £5000 and possibly a disqualification for no insurance. It might be worth posting your query on 5ive-o for expert advice. And I endorse the comments above about speaking to a solicitor.
so his policy was cancelled without any notification or contact or attempt to refund paid premium.

if they cancelled it then thay have to send the cencellation letter by recorded delivery, this is a legal requirement.

What time scale are we talking about here, between the cover starting and being stopped??

Any insurance product (house/car/cat/boat...) which is running out must have a letter telling the insured about it. I know as a high street bank I work for got into trouble over this lately and I was able to prove I did nothing wrong so kept my job :D . Didn't stop them getting hit for a nice fine though.

oh.. a IN10 on his licence..... thats much badness!

oh dear!

I had a similar problem, with insurance only last year. Thankfully no police involvment.

Bought insurance online from large company, payment made. 2 months later a letter saying no proof of NCB and that I'd been charged the full price ( funds had been withdrawn by DD ). If they didn't receive proof of NCB policy would be cancelled after a further 28 days.

Sent off proof and got additional payment back less

I would like to think that common sense will prevail, especially with a solicitor on board.

Cheers for the input guys - a post has been made on 5ive-o. I'll update as and when it gets to court. Poor lad, needs his car for work :(
