They could probably argue that you failed to take care of the goods by increasing the mileage, so lowering the final value.

As such the mileage charge could be considered a recompense for that.

 

I understand what you are saying but they cant pick and choose who they apply this too when everyone has signed the same contract.  It should be written in there clearly from the start and can't just decide to start doing this.

I think servicing and looking after the car is more of a factor rather than mileage. Don't think I will be buying another Skoda to be honest. Was going to order a new Superb but unsure at present.

Hello. So are you still going to VT yours? Is the complaint that will take 8 weeks actually with Skoda themselves? How can they explain that people with the same contracts have not had to pay the excess mileage?

No I agree that, but they may say well up to X miles, we'll just not bother, beyond X miles we will have to.

 

At the end of the day using VT to get a new car is a bit of an odd one, because the laws were put in place to help those who could no longer afford the credit.

The law is there to protect you against a number of things, not just not being able to afford the repayments.

 

Who remembers the most stolen car ever - the Sierra Cosworth? It reached a point where you couldn't insure one of these, and people had a car on finance that they could no longer insure or use. So, they just handed them back to Ford finance or whoever the finance was with.

In terms of PCP:

 

Equity = The amount you have over paid for the car!

Negative Equity = The amount you have under paid for the car!!

 

There's advantages to either. If you have negative equity then you have paid less than the car depreciated, but you have only overpaid for a car with equity at the end if you hand it back.

If you part exchange it, sell privately or pay it off like the large majority will do, then you get that money back so you definitely haven't overpaid.
