Isn't that because they have always been legal in at least one EU country, which be default makes them legal in the UK (unless that is repealed after Brexit?).

That's not how EU law works - it's only unified where each country adopts the same regulations - UK has different medical standards for EU-standard licence groups and of course we don't have any unlimited roads here, unlike Germany.

Not sure the EU had much to do with it. It wasn't illegal to sell a car with a spacesaver or to carry one in your boot and one assumes the manufacturers claimed them safe to use, so pragmatism won and no one was prosecuted for actually using one. I guess eventually the law changed to suit the de facto situation.

We aren't repealing all EU laws by default by the way on Brexit, quite the opposite in fact.

Most motoring rules/regulations will be unchanged after Brexit - there's no value to the UK in isolating our motor industry by have different regulations just for the sake of it, especially as they'll still need to make EU-compliant vehicles to sell them there.

Agreed (and I can't think of a glaring example of anything that needs to change) but that being said manufacturers have always made different versions for different markets to comply with local regs.

You 100% sure about that regarding vehicle law?

Under UK law DRLs are illegal, and the Belgian and German DRL regulations are different (Opel/Vauxhall follow the Belgian regulations as they are cheaper to implement but VAG follow the German regulations) but both are legal in all EU countries including the UK because of the precedence of EU regulations over any local law. It's what the Single Market is all about...

I never suggested that, but the Government have consistently said that after taking all EU law into UK law they will then examine each law on a case by case basis so it cannot be assumed that what is current EU law will remain as UK law in the long term.

EU law doesn't have precedence - in the UK it has to be enacted into UK law, in the case of Road Traffic Act by continuous amendment with direct references to EU Directives.

Not necessarily, you don't need a 17" for the rear. It's more faff, but if the puncture is on the front you fit the spare to the rear and the old rear wheel to the front.

Agreed, but if you want to go down that road you don't actually need a spare at all. There are other options like foam but they have limitations as well

The whole point of fitting a good spare is to be safer and make things easier if you do have a tyre problem.

I would not relish having to spend double the time changing wheels in the rain on the side of a fast moving road or motorway especially as a workable option is so easy to come by in this case.

This may not directly answer the original post but seems relevent and may help someone.

I just ordered new FL Octavia and to save on cost dealer agreed to swap full-size (16") from my current 2014 model to the new car at point of collection.
