It's an '06 plate, so new shape, but not quite brand new anymore :( lol

Back to topic, can anyone answer the question, is it illegal for a vehicle over 3.5 tonnes to travel in the outside lane, if it was registered before 2001???

I believe it is, but STILL can not find any where on the internet that backs it up.

As a wagon driver and trying to find out what the ***k the new regulations mean asking VOSA :finger: is like p*****g in the wind, find a Traffic copper you know the ones with the flash fast motors.

Post on 5ive-o - it's a site run predominantly by police and they'll know the answer or know someone who knows the answer :D

I have to agree, why mess with it, its been this way for may years, but as i have said, they have changed it now, and there is nothing we can do, BUT where is it written???

VOSA seem to have cocked up and not done it properly.

If a pre 2001 7.5 tonner got pull up driving in the outside, would the police have a leg to stand on, as they could not quote the highway code, as it has not been re-written yet???

That was interesting, the on-line The Highway Code still states that the limit for HGVs on m/way is 60mph!

As stated by Scooby Chris, the new highway code is being written, and will be out in a few months, but as of now we can only go by the old one.

I am not 100%, but im sure someone will come back with the correct answer, but as i am aware, it is as of 01/01/2007.

I am just awaiting a call back from a guy at the DEPT FOR TRANSPORT.

So i will inform you all of what he says.

IVE GOT THE ANSWER

I have just spoke to a nice young lady at the Dept For Transport.

The answer she has given me is:

Vehicles over 3.5 tonnes which were registered before 2001, dont need a limiter which I already knew, and then she went on to say, these vehicles ARE allowed in the outside lane.

They will be allowed there till next year, when the National Speed Limit is to be Enhanced, and when it does, these vehicles will be taken into account

So it does look like the speed limit is going up for us car drivers too. ABOUT TIME TOO.

To be truthful, i fully agree with you!!!

But if it dos go ahead, i will be one that will be telling the do-gooders who dont agree with it, to "Go get ****ed"

We need to fall in line with europe, French motorways work so well, and most are only 2 lanes, all because, they are taught how to drive.

Sorry, bit slow off the mark on this topic but I work in a transport office and can confirm that goods vehicles between 3.5t and 7.5t that are either registered before 2001 (or 2005 and after) can still, at time of writing this, use the outside lane as they don't have speed governors fitted. I think, but not 100% sure, that the later vehicles will have to be governed in April this year. Once they have speed limiters fitted they have to have stickers in the cab to warn the driver and they are then NOT allowed to use the outside lane. I don't know for sure as it doesn't directly affect my job but I think coaches are exempt from the speed restrictions at present. I've got the VOSA stuff at work but not really interested enough to read it!

PLease look at some of the earlier links from the vosa website.

How they read state that if they are after 2001, but dont have the limiter in, they should not be on the public highway.

I will go and copy the wording onto here, so hopefully no one gets in trouble by this silly rule

Using the Outside Lane of a Motorway

If a vehicle has, or is required to have, a speed limiter fitted and working, then it is not permitted to use the outside lane of a three or more lane motorway. If the vehicle is required to have a speed limiter fitted but it is not working, it will be illegal to use it on the public highway under the Road Vehicles (Construction and Use) Regulations 1986

I am hoping that i am reading this correctly, please feel free to tell me if i'm not.

Yes that's basically what I said in my post. At present newly registered vehicles still don't have to have the limiter fitted until later this year. Anything before 2005 MUST have a limiter fitted if it's used on the public highways unless registered before 2001.

Oh and edit to that, but a bit off topic, as of May this year all newly regisered vehicles must be fitted with a Digital Tachograph unit.

M-Way limit for HGVs is 60mph but EU legislation mean limiter at 90kph = 56mph. If no limiter then legal limit is 60mph.
