I cant get over this possible FRAUD (furious! )

Sounds like they wont get anything to me, if that happens i would make sure your insurers pass on her details to the police regarding her attempted fraud. good luck.

Good thinking as i dont want a brick through my window when it all falls through ;) after all the other party has my details :rolleyes:

The Saga Continues...Just to let you know that I have had another engineer who came out to inspect my car again today (15th November) He told me that he was "looking for the truth" and said that he was independent and had also inspected the third parties car prior to looking at mine (the one who made the damage look worse) I was concerned as he said that the first engineer logged down that my vehicle is used for private hire! :eek: which I was alarmed at and explained that it has never been used for this purpose and at 10 years old with 69,000 miles i dont think so. I don't know how or why the first engineer would even suggest this?

When I asked what his professional view of the damage to my car was after he inspected both cars concerned he said that he would have to do the report first which should go back to the people concerned during this week.

I have now asked to know why was another inspection carried out or needed, is this because the other parties insurers dont want to believe that the damage to their customers car has been made worse to substantiate their claim for personal injury etc? and more importantly what happens if the 2 engineers are at deadlock with this (one says the damage was consistent while the other says it was not?) I feel this is dragging on a bit now just for a minor bump :rolleyes:

He did however inform me "off the record" that there was hardly any damage to my car and in his words stated "are you sure you haven't a magic wand....as the damage is very minor indeed" I just explained that I believe from the outset that the other party has made their damage far worse as when at the scene of the incident there was no panel/paint just a slight scrape on the bumper like mine. He then explained that he was again independent and just out to find the truth in the claim concerned.

I am still confidant that even after this inspection the out come will still prove that my car did not cause the damage to the third parties car to the extent of what they are sugesting etc.

I have now found out from my insurance that the other car has been classed as a total loss from the other crash they were involved in a few days after mine and as such another insurance company has paid out for the wrote off car.

Bearing in mind this other accident (which wrote their car off) was a seperate crash to the one they are persuing me for does this mean that my insurance dont have to make any payment for their car as this has been paid out by a different company.

Bearing in mind that this payout was in relation to another crash they were involved with just days after being involved with my incident.

The car was only a total loss after this accident but wasnt a total loss when it hit me, so althouugh the incident involving me caused very minor damage (a scratch) then surley because another insurance company has made payment then my insurance shouldnt be oblighed to payout aswell (should they)

That means they will be paid out twice from 2 companys for the one car and because of the second bump they were involved with was much worse, its now hard to prove what damage there was regarding the bump with me.

God I hope this gets sorted out soon, As the personal injury rubbish is still being disputed despite 3 engineers reports favouring my insurance company and nor theirs.

Dont know what will happen next.

Just leave it with the insurance company mate.... no need to stress.

at the end of the day you wont have to pay anything, you'll just lose your no claims if they arent protected.

I doubt very much they'll cough up for the car if another firm's paid 100% total loss.

I'm more worried about why your insurance firm hasnt called their bluff and said "see you in court" yet!

EDIT, you have mentioned counter claiming for distress havent you? If not make sure you do!!!!!!!!!!!!!!!!!!!!!

i would have to agree with gadgetman, just make sure your insurers are aware that a payment has already been made. if and when the truth comes out ask the insurers about using your legal cover to sue the other party for the time wasted and time taken off work (at no pay ;)) .

They are protected mate, I just get furious as they are claiming their injuries from my insurance but yet they wernt proven as they were involved in this other shunt just a few days after.

I have emailed my insurance today to make them aware of this it was my insurance who told me that their car was a total loss from the second crash this was a few weeks ago when they mentioned that the other insurance company felt it wasnt worth repairing so wrote it off.

I then found out from a freind on the street i live knows this person and they told me they have been paid out it was when they told me by what company that i knew it wasnt mine that paid out, they told me they now have bought a 53 reg citeron picasso (another french car to upgrade their renault 19 :rolleyes:)

Anyway i will prob here something back from my insurance on monday, but they seem to be messing around and just waiting for the other parties solicitors, insurance etc to get back to them.

Solicitors are always slow, especially those who know they're costing others money.

Likely yours are giving them enough rope to hang themselves fully before unleashing the police on fraud charges

Well i finally got a letter from my insurance saying that the other parties solicitors and insurers have withdrawn all claims against me :thumbup:

This is what it said...

"We have been in discussions with the other side and pleased to confirm that both Claimant Solicitors and Insurers have withdrawn their claims against you as they have insufficient evidence and that their Client exaggerated the evidence and damage and we feel that their engineers views and inspections supported those of our engineers.



I am pleased to confirm that I have today closed your file down and re-instated your no claims bonus.



Thanks for your assistance in this case."



I am pleased about this outcome and glad that my insurance just didnt hand over thousands of pounds for something like this case.

At least the money that would of been paid out has been saved lets hope for the genuine people who need it the most.

Some good news from an insurance company.:eek: Its scum like this who make the rest of us suffer with increase premiums.

Glad its all resolved.

her current insurers will likely tell her where to go and she'll have fun finding another insurance firm for sometime I'd have thought....

Best advice to all, In the event of a bump, Especially at low speed, Take photos!

Almost everyone has a camera built into their phone, If not keep a disposable camera or a cheap digital in the glovebox

Is it worth it... hell yes assuming using your insurance legal cover wasn't going to remove the no claims bonus you have.

Just to make the point and to make them realise that defrauding insurance and trying to screw people over is not worth it. If you don't make them realise now, they'll just try again.

I really want to know if the police are going to be involved regarding insurance fraud too.

I have to agree with Paul (even though it pains me to say it :P) You are paying for legal assistance so it can't do any harm to give them a ring and ask about claiming for out of pocket expenses, and maybe stress.

I'd be inclined to just draw a line under it - otherwise you're only lowering yourself to her standard in trying to make a "tit for tat" claim.

Rest assured she will have horrendous problems getting insurance in the future and her insurance company will probably have their fraud investigation team watching her very closely in future:D

Personally I'd make sure she doesnt dance again!!!!

Not at all, she was being fraudulent, why should the OP have suffered and be out of pocket because of this woman. I am sure anything he did win, the insurers would be looking at getting reimbursed by the fraudulent claimant.

I'd thinka couple of days off work while waiting for the inspectors to come plus a token payment for the running around and lost interest on any renewal made would be fair.

Cheque for £100-200 should I think be reasonable to cover lost holiday assuming the OP too the two days as holiday.
