I cant get over this possible FRAUD (furious! )

Apart from a couple of bruises from my seatbelt I was uninjured yet my insurance company badgered me incessantly to lodge a claim for personal injuries which I refused to do.

Thats because you were honest about it:thumbup:, I Wouldnt mind if she was injured and in pain.

I have been getting an update from my insurance, They have wrote a letter to her solicitors saying that they are not going to make any offers in relation to their client as there appears to be a discrepancy relating to damage sustaned to her car and as such have instructed a forensic collision engineer to inspect both cars. :eek:

Forensic :eek: Nobody was killed. I cant wait for them to see mine but i think when she finds out she will be worried as they know that they doctored the damage to make it look worse.

What do you guys think of this turn of events, with my insurance writing to her solicitors saying they are NOT going to pay any personel injury claim wont this mean they will turn and hassel me.

AFAIK you will not get hassled for compensation because that is what the insurance company is for. If your company will not pay out then it must be for a legitmate reason and as such she will not be able to claim of you either. Also compensation lawyers are only interested in these sorts of things if there is a ready source of money to get i.e. from an insurance company who will pay out in full. You would be able to argue that you do not have enough money to pay out fully so be given a payment plan (heard of these being as low as £5 a week). Not exactly profitable for them so they will not both!!!

In order to have an injury which would warrant a £15,000 payout, there would need to be significant proof of a high level of income, and total and irritreavable loss of earnings, no previous ailments.

Additionally, there would be nothing left of the Renault should such an accident have occurred.

It's too late for that now, once they have instructed those guys, she isn't going to be able to get insurance anywhere. If she drops it it's obvious she is playing and if she doesn't drop it and is playing up she is going to end up in court.

Either way her insurance co won't want to know her.

Who are your insurers as I think not just bending over is something that they should get praise for.

If they do, refer them to your insurers.

Send any correspondence to your insurers and send them a letter (special delivery signed for) stating that your insurance companies legal team are your point of contact in this matter and that you will not enter into further correspondence regarding this matter.

Give your insurance companies details in this letter too as then they can't have any reason to contact you.

My Insurance is Allianze and I had a phone call from them earlier to say that they are Investigating the claim and will be in touch as soon as they have a letter back from her solicitors to see what response they get after they sent them a letter saying they are not paying out for any personal injury claim.

I have also learnt that the other road traffic accident they were involved in just 2 weeks after mine was that they were driving another car.

So i feel that if she had bad muscle strain, whiplash and Jolted Spine then how could she drive just 2 weeks later.

I am just glad that my insurance are keeping in touch with me. Will keep you posted.

Just trying not to worry about this :( as they have my address and hope they dont come round giving me greif just because they may have been sussed out.

Can we get camera footage of her opening the letter? Seriously dont worry about it, as she's screwed herself trying to pull a fast one.

And if she's trying to claim for another accident, she'll end up the loser in all this.

To be fair it couldn't have happened to somebody more deserving.

Sound like a right changer who is up to her eyes in credit and fancied paying it off on your expense.

I hope the insurance companies and then the police leave various book shaped imprints in her head.

***Update***

My insurance company have enlisted the services of an independant collision investigator to come and inspect my car and hers. ;)

They are coming out to mine tomorrow (friday 25th Sept) and have been intouch with her solicitors to request that they inspect her car.

Aparrently they have to go through her solicitors now she has appointed them in respect for the personal injury claims she is putting in.

I cant wait as I am certain that they will realise that my car would of come off with much more damage especially when they see her damage which has been done by themselves (to make it look worse)

Anyone know what these investigator people will be looking at when they come round tomorrow, My insurance told me that they will take various measurements from the impact point.

will post tomorrow when they have been to let you know what they reckon.

So far though she hasnt been paid a penny :thumbup:

I will do anything to help my insurance company from paying out bogus claims :thumbup:

People like her should be put in jail for trying to pull crap like this.

Looking at the pics on the previous page of this thread I would have said that you could have done that damage to the R19 as they are made of tin, however it's a very precise impact and hitting the side of the car would have done a lot more to the paint on your bumper than you have.

To be fair I think you'll find if she hadn't tried for PI they would have paid her off, but when she started trying for the bigger money, they though bugger this for a game of soldiers.

If it's proven to be negligent do ask your insurance co if they will be taking legal action and if not, do remember that you might be able to take civil action against her for any damage to your reputation or time off work and stress etc she has caused by her allegedly deceitful actions.

I have experiences of the similar, firstly a close family friend is a disputed claims investigator and from what ive heard they will do anything to make sure that their client isnt affected in the event of fraudulent/disputed claims, so youre in good hands there.

Secondly when i lived in Bradford stuff like this would happen all the time, the favourite was following a car into a multistorey car park (without CCTV) The car in front which happened to be full of people would roll back into the car behind, and all the people inside would claim for injuries individually after saying that the poor victim had run into the back of them, and without witnesses and CCTV they would normally get away with. A couple of my friends were victims of this or similar scams, i can count myself lucky that i survived 4 years driving in that hell hole without an accident.

I had an accident when i had been driving for a couple of months, due to my naivety, inexperience and ****ty old car. It hit a brand new A4 estate, luckily she had a towbar so all i did was bend that with no other damage. A passing ambulance stopped and checked us both, she said she felt fine, she seemed more concerned about me i think (bruised spirit :o). She said she wouldnt be claiming for an injury, and she kept her word and didnt, so i guess there are some honest people out there still.

I think people get the impression that personal injury claims are easy money, but luckily the police are starting to clamp down now. It seems this (i wont call her a lady) shot herself in the foot by being greedy, i hope they throw the book at her and i hope all turns out ok for you.

I know what you mean there, and it is such a pricise impact and like you say My car would of come off much more worse than a scrape on the bumper.

I am still waiting for these crash investigator people to come, I am looking forward to it.

Well the investigators have been (after waiting all bloody day) and they did the following.

Took a statement of fact (as they called it)

Took a picture of my tax disc :confused: (why do this?)

Took a picture of the VIN Plate and noted the numbers

Took a picture of my dashboard mileage reading and noted it.

Checked every tyre and took pictures

Took a picture of the number plates front and back.

Put rulers near to the scrape on the bumper and took pictures.

Took a picture of the engine bay and the inner front wing

Took a picture of underneath the car behind the bumper

The person could not beleive the small amount of damage to my car and he had the picture of the other car (green renault 19) with its smashed wing and he told me that in his profesional opinion I wouldnt of done that amount of damage and if so there would of at least be a crack in my bumper and damage to my front wing.

He also added that the damage to the other car is far to high even if allowing for brake dipping (whatever that means)

So he went away and said he will put everything in the insurance report while they still wait to inspect her car.

Dont know now what my insurance company will do but i was pleased to hear from him that their damage seems to have been "dramatised to look worse" in other words i think he was trying to say they were taking the p.

Why did they take pics of my tax disc though and noted its seriel number? :rolleyes: All the neigbours came out wondering who this guy was lol

Standard practice, nothing to worry about. They are just covering the bases and makeing sure that your car is road legal.

At a guess they took note of all your vehicles identifying marks to ensure that you had not swapped plates over to a similar vehicle whilst hiding 'your crash damaged' vehicle and passing another off as the one involved in the incident.

Slightly unlrelated matter, but I am assuming you are in the UK? In Ireland, we have this thing called the PIAB... the "Personal Injury Assessment Board". It's possibly one of the best organisations that has been set up in recent years for this very reason. the result is that insurance claims have gone down... hence my insurance came down by 180 last year alone. You don't have Jonny the ****** claiming €25000 for a broken finger from giving someone a box in a pub, and you don't have the same Jonny claiming for 8 months sick leave from whiplash from an accident like the one you were involved in. It has put a complete stop to it, much to the dissappointment of a few barrister friends of mine. More importantly, they absolutely BONE (no innuendo intended) people like your new lady friend as they treat it as insurance fraud. So check out if you have such a service there...

Good point there mate even I never give that one a thought. I just wish they would hurry up and look at her car.

How long will it take for my insurance company to get the report from the investigator as it was an independant firm (aparently it has to be done by a company thats acting independant from my insurance)

I would not mind if she had problems but she doesnt and I would rather see people with proper injuries get the help they need.

BTW "forensics" have nothing got to do with death or killing. Its a term used to describe written or oral reports or evidence given by qualified and recognised experts in a discipline (engineering, accounting, medicine) used in legal argumentation.
