Approached a roundabout with a VW golf infront of me or to the side(cant remember), he was in wrong lane anyway so I stayed in my lane and exited the roundabout and completely sidewiped me. Cheeky sh@ had the audacity to blame me saying "you should not of undertook me and its a single lane exit" I replied "how could I have undertook you in a single lane if you wasnt in the wrong lane. It was also a foreigner(canadian) I think in an AVIS RENT A CAR.

Not happy and taking no blame!!!!!!!!!!!!! :dull:

I've got almost EXACTLY the same scenario everytime I come home from work and people always go into the wrong lane. Luckily I expect it and leave a certain amount of room.

You did well not to let your emotions get the better of you in that situation.

Certain companies will if the car repairs are more than 60% of the RRP otherwise they just repair it

Which makes sense, but on a brand new car that would be a fairly hefty bill.

Used to do reshells back in the day but I think even internal labour rates and the complexities of the modern car have made that a thing of the past I think.

My 6 day old VRS has just been hit!!! two new doors, new back panel and new sil :'(

So sorry jordo !, I would have thrown a wobbly lol, going to be costly did you get the fuzz involved if the pollock was trying to blame you , did you get witnesses?

Being a a very short fused person that gets annoyed when people have accidents and block road i drove for around 20 meters and pulled in so traffic can get passed whish I wouldnt have now. it was his front wing and all my side from drivers door to back panel-cant see how thats my fault. I will upload pics in a little while

Well if it's his front panel and all your side, does look like his fault though did he put his hands up to it or does he still argue that you were to blame?

Gutting - I would be fuming if that were me. Make sure they do a top job and go to a repairer of YOUR choice not the insurers.

At Christmas, we were stationary when a van coming towards us, slid on ice and caused similar side impact sill/door/rear panel damage. No witnesses but obviously the other blokes fault BUT his insurance company said 50%/50% blame. My company wanted an easy life and were prepared to go that route till I insisted they fight it and that we wanted to go to court.

Only then did they agree to fight the case and his insuance company "then agreed" and paid all costs (including hire car and my costs to get car to repairers and phone calls, letters etc.)

Had they gone the 50%/50% route, I would have lost my excess AND had a claim against me. Although no claim protected, if my company hikes the base insurance cost next year (to get back some of their loss) I would be forced to stay with them because to go elsewhere, I would have to declare the claim and would therefore have zero "no-claims" discount as far as the new company were concerned.

Also, when you get a car during the repairs, make sure it is a LOAN car from the repairers and not a CREDIT HIRE AGREEMENT car arranged by the insurers! See http://www.seered.co.uk/credit_hire.htm

I realised (after the event) that my insurer's had gone the credit hire route and had I agreed the 50%/50% route, I think I would have had to pay all the car hire costs.

Even if you have a non fault accident insurers load your premium and yes credit hire is bad news!! Worked as a claim handler and fraud handler for various companies over the past few years dealing with that and dodgy accidents
