Have been told today by phone, so its not offical yet, that my 11 month old Octavia L&K 1.8 is a total right off from a rear impact.

Does anyone know if I have a choise legally of deciding who supplies a new replacement, as without reading the small print get out clauses in my policy that is what I am entitled to. I would rather my local dealer than an insurance company as I cant see them having one on the shelf anywhere in the correct colour, so it will have to be built anyway.

First things first, does your policy include new car replacement? If so, the option to invoke this is with the insurer, as stated in your policy.

If they go down this route, they may well obtain quotes. When I worked in insurance claims, we always got 3 - supplying dealer and 2 others close by. If they replace your car, then it will be ordered in the same way that you or I would order a car.

Bear in mind they may be aware of order times and just offer you cash, again the policy allows them to do that. If you need any help or advice with them then just pm me.

Now been told after I contacted them to find out progress that the car may not be a write off. Was £10000+ damage. Now on further inspection has risen to £14000+. This is way over the 60% line for declaring it a write off. Body shop says they have not repaired a car to this extent ie new shell for over 20 years, and could take 3 months once they get the main parts.

Not too happy at the momment.

Again it's at the Insurers option. A reshell is unusual on anything below mid to top end BMW's, Jaguar's, Mercs and the like.

I wonder if the delivery delays on new vehicles are influencing the decision? If you're unhappy you can complain and they'd have to give you a full response to your complaint and justify their actions.
