Thank you all once again for your fantastic help and advice we still have heard nothing from the *&@$# and weirdly enough I chexked his facebook this morning and as ofyesterday he has the car he hit us in up for sale!! So can I rest easy now? Been worried sick about it all and has really knocked my confidence just because of how they behaved more  than anything... im praying that they just tried their luck and got nowhere so have given up... we have covered ourselves telling the insurance thanks to your advice and also sent a detailed timed account and photos of the incident to the insurance company just in case but im hoping the fact hes sold the car could be the end of it all? 

Sounds to me as if the car might have third party, but perhaps not for the people driving.

Did you get a picture of the driver? If so make sure your insurance has that too.

That saved me a lot of trouble a few years back.
