Help and advice needed about car park prang :-(

Hi all.....

Now its a long one so do bear with me but id rather tell you the full story so you can get the idea.

Here goes.... saturday toys r us car park with hubby - me driving.... reversing out of bay we were almost straight... we had parked by a speed hump and had crawled over it reversing and then were hit by another car reversing almost opposite they pulled forward and so did we.... all getting out expecting an oh dam it will polish out etc.... wrong.... met with two mouthy chavs.... bloke flailing his arms about swearing then straight away he gets on his mobile and walks away talking on his phone leaving his girlfriend screaming at me that she has kids in the car as if we had had a full on head on not a small bump at extremely slow reversing speed... one of the kids about 4 years old sat on front seat no booster eith seatbelt on (isnt this illegal?) She was in the back with a baby of about 9 months.... she slammed door on us saying I dont want to speak to u.... so I went up to her chap on the phone and said shall we just calm down and swap details there is not much damage he turned his back and walked off.... so I went back to our car to get my phone to take pics and she comes flying out the car where the *,?@@@ you going I said getting my phone and your bloke wont tslk to me.... she said well you will have to &$@@@@@ wait till hes finished speaking to his mom!!

Hubby said oh do its not your car then and she said yes it is and slammed the door back in the car again.... we checked stupidly the wrong side of our car for damage to be honest the reception we got getting out the car kind of threw me and hubby off amd were a bit shaken.... anywsy we said look not alot of damage no one died lets calm down.... her bloke returns saying you owe me a bumper.... 150 quid!! Hubby choked and said I can get one for 40 quid if it was all our fault..... he said well get me one then.... hubby said lets swap details and sort it properly... their black golf was battered and half of what was where we had bumped was already done.... we swapped names and addresses and drove away.... I said to hubby hopefully that will be the end of it.

Got home to realise the scuff and paint chipped off where they had hit us on the drivers rear side bumper.... this also now showing that from the angle that they backed into us when we were all but straight. Still we have all the polishes etc and thought yeah ok polish out anf paint pen the chips and fractures.... thennnnnn....

Text message from mr chav this afternoon....hi mate so what you going to do about getting me a bumper? My hubby text that he would prefer to call him he was told that he couldnt cos his mobile speaker was nroken.... so can we call u at home? No he said we dont have home phone... ok email? Dont have email....he asked why my hubby couldnt just text and he replied as is true that he is slow and crap at it lol.... bloke said he had now got a witness that says it was our fault... ( no one was about when it happened and they left the car park when we did) im assuming this will be a mate who has said he be a witness.... he has also now said they were stationary and we reversed into them.... andddddd that they now have whiplash??!!! .... husband has said that our car had damage too so if he gets him a bumper wi he be getting us one?? We have also asked 3 tines over these texts fkr his insurance details and he never gave it to us.

He has now gone quiet since 5pm probably plotting his next stratedgy..... I have since turned into super sleuth and looked him up on fb and turns out hes a banger car driver as a hobby! !!! Funny how whiplash doesnt affect him then... lol.

Anyway im actually a bit gutted about it as im a lover not a fighter and they are obviously trying their luck... im also worried that they have our home address when they arent very nice people... just wanted anyones help and advice... thoughtd and views as to what to do.... ive been told we should ignore any further texts from him... im sory for any rambling :-) be good to hear from you guys about this situ.... happy bloody christmas eh lol :-)

Ignore any messages and do not reply. Just tell your insurance company exactly what you have said here. Sounds they may not have insurance but that's just presuming. You pay your insurance company to sort it. If they start to get mouthy or even threatening then ring the police.

Pass his details onto your insurance company, also ask Toys R Us for cctv and remember that anything that happens on private land is usually at your own risk.

 Might also be worth reporting the incident to the Police, see what they have to say.

 

 Finally, if you have the registration number, enter it in askmid website and this will show if the car is insured.

If it is a damage only incident then the police would not normally get involved.

I agree that you should ask Toys R us if there is any CCTV. Do it quick as they recycle the tapes quite quickly.

I would keep an accurate record of all correspondence between you and the third party, including any phone calls.

If they have your address then I presume you have theirs?

It might be worth being a bit sneaky and doing a drive past to see if you can confirm the address, just in case.

I wouldn't respond directly to any of their correspondence, particularly text messages, just pass everything on to your insurance company and let them deal with things.

I had a prang back in September, single track road, blind bend, head on with another car. Not mega damage, fixed my car with a hammer :D. At the time, the lady who was driving was reasonable but then she called her husband who arrived about 10 minutes later. He started getting all ****ty with me and started making all the accusations so I politely, but firmly informed him that I wasn't prepared to get into an argument, particularly with someone who wasn't even there, and I would just pass things onto my insurance company. After an initial contact about two weeks after the incident, I haven't heard anything more. I did a bit of digging and it turns out the guy a a full on property tycoon so perhaps he might've lost interest in a minor claim.

Thank you so far to the guys above for your replies... we did swap addresses so yeah they have ours too... we ideally wanted to avoid insurance claims and at are end willing to sort the minor damage as it would certainly cost less than the excess... obviously if they want to claim then we have no choice just dont want our premiums going up next year over something so petty. I also personally feel crap about contacting the police over this being such a small incident also :-( but if I need to I will. I will contact toys r us about cctv tomorrow but from what ive googled they dont have to give it me or let me see it as its a private car park. So if this guy texts my husband again should he just ignore it? I believe they do have cctv from signs ive seen up but its a hugr private car park do not sure if it would be covered I will certainly ask

If there is cctv tell your insurer and the police.

If they failed/refused to provide insurance details, I would contact the Police and fill them in with all you have told us. Would be a fantastic outcome to find out they are not insured at all and would vanish back into the woodwork with Police now on top of them for that and you just get your car sorted yourself. The CCTV side, might at least show there was no extra witness around.

 

Front and rear cameras in my car for exactly this sort of thing. I would like to think that in a similar incident with equally degenerate people, simply pointing out that it's all been recorded and still is would stop them playing any silly games. Not happened to me yet but it's experiences like your's that are one of the main reasons I have them.

Your risk of not calling your insurance is them going full blown on claims of Whip Lash.

James.... yup I answered about it above thanks for that info... the car is insured but it could be insured to his mum as he jumped straight onto the phone to her as soon as it happened... and maybe he isnt on her insurance ??

I know it won't necessarily be a popular answer but you should just let your insurer/broker handle it - it takes away the hassle of dealing with the other guy and hopefully means you can head-off the whiplash claim.

No thats what ive been told today also just to let them know not that we want to make a claim but so they are aware of the incident would make thingd look better for us going to insurance and they did say just making a record of it wont affect our premium.... ive aldo checked and no cctv at the car park... what did you mean about heading off the whiplash claim? Sory im a bit blond on these insurance issues lol also been told police wont be interested as no injuries and it was a private car park

If you sorted it out privately he may still come after you with a separate whiplash claim. As you hadn't gone through the insurance you probably wouldn't be able to use their solicitors to fight the claim. If you go through the insurance, they're used to assessing whether whiplash is a realistic feature or not and can rebuff the claim for you.

Ahhh I see thanks for that... hubby has just called and told me he has rang our insurance and reported it they then told him the guy has insurance with them... which for one, having done the askmids check as suggested by james above is s different insurance company so im assuming that it was moms car and her insurance on it and he has seperate insurance ehich maybe doesnt cover him to drive her car??

Any further texts hubby is going to text back thst if he wished to persue please contact the insurance company and ignore anything else. I just hate the uncertainty :-(

Hi all...

Just an update... we have had no further texts from the "lovely people" who hit us saturday... we have taken your advice and our insurance company of the incident to cover us if they start up again.... im hoping so much that this will be the end of it and hes tried his luck with us to no avail.... we also think that he may have insurance as the company told us but that he may only have 3rd party which is why hes not persuing it through his insurance and trying the personal approach... im womdering if there is a specific time limit that he has to report anything if hes going to... wpuld just be nice to think that after so many days or weeks that he cant decide tocome at us again.

The insurers will probably close off the claim if they haven't heard from him after 6 months but that doesn't stop him claiming further down the road. Not sure what the legal limit is for claiming.

To put in claim from a TP (i.e. him claiming off you) it's 3 years for Personal Injury and 6 years for property damage.

I always thought that was the wrong way round, but has apparently been like that for years on the grounds that you know immediately if you've been injured, but, for example, damage to a building might take much longer to show up.

 

Notification of a possible claim to your own Insurers will vary, check your policy for details.

Many used to specify 28 days, some 24 hours.

Failing to provide details is an offence isn't it?

 

Take his reg plate, give it to your insurance company and point out that you've asked for insurance multiple times.

Then fix your own bumper and tell them you're not claiming, however you are worried he may make a fraudulant claim for whiplash etc from some of his comments.

 

Leave it there.
