I was undertaken at a roundabout earlier tonight

 

First comment was "Mate, you came into my lane"  Then I said I have a Dashcam and his attitude completely changed.

I'm not sure he did although you can hear I had to floor it to catch him but I'm sure he was just going to the hard shoulder rather than stop on the sliproad

If you look at the road markings all the way around the roundabout you will see both lanes are marked for the A3(M).  Also look at the Leon in front of me.

I have had two (one pointing front and back) fitted for a couple of years now.  I seriously hope I never use them beyond getting trackday footage.

From the video the incident looks 50-50 to me. Other driver moved over one lane without paying attention, but you swiped from right hand lane to branch left too late and unpredictably. He was not really undertaking you because up until the last moment you appeared to be heading towards the right branch. If you were in the middle lane I would pin the fault on other driver 100%, but you were not and made a rather agressive move left. You also had time to see him and brake or edge right before he hit you. Show the Insurance that video and they will likely find you both liable because you both could have avoided the accident by paying more attention and driving sensibly/predictably.

I disagree, both lanes are clearly signed for the A3(M).  I drive it almost everyday and that is the correct use of the lanes.  Two lanes on the roundabout (there is no 'middle' lane) and two lanes on the sliproad.  He clearly comes into my lane after I have gone past him.  Look at the Leon in front of me, he does exactly the same.

Sorry, but the right-hand  lane you were in was marked straight-ahead and right only. You swiped left too late and an assessor from the other Insurance company will see this instantly. Both Insurers will share liability and costs because it will be too much hassle arguing between themselves. Best not show them the video and hope the other party admits liability. If he did not have a camera he will be doubting himself and where you came from.

 

I am not trying to be difficult, but just supply a balanced assessement given the one angle we can see. I have had little bumps in the past, and although not entirely my fault I could have prevented them by being a little more cautious. It's annoying at the time but try seeing from the other Insurers perspective. You both could have prevented it easily.

 

edit: It does appear that he thought of doing a runner and then changed his mind. His manoeuvre right was also strange because he was travelling quite fast and there was another car just infront. The car infront of you took the same line as you, so maybe it is common practice on that roundabout, but if I was travelling behind you I would have assumed you were continuing right until the last seconds. Was you indicating well in advance - I cannot see it in the recording and there is no yellow reflection off the road or off the car that hit you?

Nice to have the ability to film such incidents. In Luxembourg it's against the law to put dashcams in the car as you infringe on the other drivers privacy since you don't ask them for permission to film them. Same goes for cameras on your property, they MUST NOT cover any public space (road or sidewalk) other wise it's not admissible in court (and more to it strictly against the law). So good luck proving such an incident to your insurer or the police over here...

I know. When I first came to the UK for my studies I was "shocked"  there were cameras on every corner filming my every move. Now I'm pretty sure that nobody was interested in me, but just installing cameras on trains and in the main railway stations was a complete culture shock for people around here and lead to much controversy as well.

It would be nice to be able to have them on the car at least, though looking at the footage from Russia, UK etc. I doubt that it makes the roads any safer. But maybe it helps with the insurance claims.

Both lanes are marked A3(M) and as you can see here the Golf is clearly out of his lane:

Whilst it is tricky to see from the video, the golf should not have even come around the roundabout from the 'ahead only' lane he was in. After passing the junction previous to the one you took, the road becomes two lanes, one for joining A3(M) and one for joining or carrying on around the roundabout

To the person that said the golf was entitled to have gone right across OP's path....have I missed some thing or do roundabout work differently where you're from?

Golf moved right without paying attention, whilst OP appears to have been within the wrong lane for exiting the roundabout and pulled over too agressively. Unfortunately neither saw the others move until too late and they both met in the middle. I think both have reason to feel a little aggrieved.

Edit. I can now see the straight on/right arrow as you come under junction. He's still in the wrong though
