As far as i understand you are aloud to speed up while overtaking and then you must drop back down to the limt, Thats how i understand from my friend who just takin his IAMS test.

I'd get your mate to check with this observer before his test. At no point are you legally allowed to speed, overtaking according to the highway code must be done within the legal limit. :thumbdwn:

Dont you just love learner drivers! Firstly let me say that the instructor had should have been getting the pupil to do at least 40mph in a 50mph.

But would have really delayed you to any large extent just to chill out behind the learner?

Ever thought the learner was having a hard enough time / nervous enough without you blasting past him?

And is you where taking effective observation of the road ahead would have seen the copper?

Please folks can we cut learners some slack they are nervous enough without other drivers getting right up the tail pipe or blasting them of the road as they overtake.

But like I said at the start the instructor should have been getting the pupil to make proper progress.

TBH mate if you get a letter from them then you are fecked.

Been down the route of trying to claim my innocence myself, the law is weighted against you I'm afraid.

There is a huge amount evidence to discredit these scamera's but unfortunately us mere road users don't have the funding to pursue such cases and it becomes a matter of economics.

I personally think that's exactly what the Police want, take it on the chin & pay up.

Last year I was caught doing 60mph in a 50mph zone by a laser camara in a marked van. Motorists travelling in the other direction were flashing their lights & my snooper went off, so I knew it was there & I was sure I wasn't exceeding the speed limit. I viewed the photographs taken by the Safety Camara Partnership, I was between two vans & was taken from 500 metres away. I was offered the standard £60 fine & 3 points but did not take this up.

Six months past & no court date was set. I don't know if this was due to them not having enough resources available to pursue the case or if their "evidence" is that watertight.

I went to court to defend myself, traveled 400 miles to get there two days off work and a night in a hotel. Got in there sat amongst all the local scumbags and their legal aid lawyers.

Usher came and asked me how I intended to plea to which I replied that's my business and you'll find out when I get in there. Doesn't work like that I was told, so I relented and told her that I intended to enter a not guilty plea. No problem she says with a smile, we'll whisk you and set a date for your trial. Que open mouthed look from me followed by a lot of protesting that I was there to be dealt with there and then. No can do she says, the police haven't prepared a case against you, bargain I said you gotta let me off then. Not a chance loser!!

Bottom line, I couldn't afford the return visit and risk a 50/50 chance of getting off. Was told by the courts that I should have known the procedure which lead to an ensuing argument about it being my first offence and visit to court, not like the rest of the scum in the waiting room, which resulted in them threatening to have me arrested.

I think that mobiles can go wherever they want. It might be slightly different for the so called 'safety camera partnerships' as they publish their locations to try and apease the general public.

mmmmmm.....There are quite a few roads around me that have the speed camara sighs attatched to the lamp posts and also display the speed limit for that location, no fixed speed camaras. So this is were the "Safety Camara Partnership " vans would operate. Mobile Vans / camera vans Anywere else including these sites....I do have a Snooper you know....;)

Loads of new camera signs have been fastened to every other lampost in costa del Mansfield so it must meen the locals feds need to start getting the funds in for the latest Christmas bash. I much rather give them a bottle of plonk or a crate of stella rather than have the sneaky barstools do commando rolls from behind lamp post to earn their £60 quid.

One of the "safety camera" operators used to drink in my local pub he was just like Brian Potter anyway he doesn't drink their now !

There is a getout if there's no signage within 3 miles or something - they have to be able to claim safety not cash - If you don't know you won't drive safer is the argument there.

Indeed and according to Roadcraft, overtaking is one of the places where it is unacceptable to speed (as it shows poor forward observation/planning). :D

Thanks for the comments guys....I'll just have to wait to see what happens. You never know....as there were two cars side by side it may have prevented a reading on the gun completely.

Sounds like you acted perfectly reasonably, it's the law that's an *** in this case. IF you do get the NIP through the post there's very little point in fighting it, unless you've already got 9 points. Hopefully it was just a speed trap and the motorbike copper used his common sense and discretion.

The limit is the limit is the limit. If you cannot overtake below it, then you shouldn't overtake. The only "margin" you may get is in the form of the ACPO guidelines (and they are only guidelines) which is the 10% +2 eg in a 30 you might get away with 35.

Repeatedly doing so on any form of test will result in a fail

What would happen if all of britains motortist suddenly thought f**k this and trashed all the local gatso cameras etc.

I mean they can't arrest all the motorists can they.

Ahh we can but dream of not having cameras as a funding top up device.

Then again what would happen if all of Britain's motorists decided on a "National Restraint Month" (not in the pervy way ;) ) and obeyed all speed limits?

I was trying to work out how long it would take for the cameras and the Safety Camera partnerships to become economically unviable :D
