Surley the tractor should have seen that you were there, or failing that indicated with their arm or something along those lines?

it doesn't matter who was driving as long as tghe car was insured and road legal. its the tractor drivers fault so his insurance should be paying for it not yours. you should be making a claim directly off his insurance!

Maybe the tractor wasnt indicating, but you dont overtake past a junction, so the insurance would view it at the very least a 50-50 but IMHO you'd be lucky to get anywhere near that.

I was going to say the same thing, my fully comp policy allows me to drive ANY car third party only, as long as I have the owners permission. I dont have to be on their policy at all.

i don't think it would be ruined on that alone as its a bit tenuous really. As the highway code says mirror, signal, manoeuvre so the tractor driver was in the wrong and driving dangerously especially if he was driving a vehicle without indicators as surely that isn't road legal.

But the final question will be...was it safe to make the manouver, obviously not in the eyes of the insurance, otherwise the coming together wouldnt have happened.

However we're both working on guesses and i just hope that it works out for the OP

Ill be honest here, and probably get flamed, but had I been in the same situation and we were both ok, I think the drivers and passengers identities may have swapped

I've had a few people interestin in buyin the lot already, although I'm still thinkin of breakin her up & sellin/keeping pieces as I already have another vRS Fabia SE.

I can't really disuss the details of the accident until the case is closed, sorry, but all i'll say is that the tractor had a large trailer & I don't think it's lights were plugged in.

oh my jesus f*cking christ!!! Thats a lot of damage!! That nearly made me sick to look at those pics because it's identical to mine!! Absolutely gutted for you, are you not going to kill the person who was driving slowly and painfully??

Nearly had similar once

Tractor but with unlit trailer - I'd seen tractor and was looking past it down the long swooping road. If passenger hadn't alerted me we'd have been into it. Stopped with windscreen one foot away from very nasty overhang of trailer. Reported it to police following day and they ticked the farmer off for having no lights.

Sympathies, to say the least.
