I havent told my insurance but i suspect he has told his, I cant ring him till I'm done at Uni which is half 1.

I will pay for both cars if settled out side coz i'm accepting its my fault, but if it goes to insurance i will contest whole responsibility. I hit the rear wheel/ bumper so i accept its my fault from that piont of view. I hadnt stopped i was approaching, saw him indicate so accelerated and by the time i broke he was in front of me.

Of course, have you only just realized thats why when you are young its really cheap to insure a nice car, but the older you get the dearer it is to insure a car

I never once said I was right and he was wrong, i said he was a "know it all" telling me what i should do and I said erm yea i was wrong but so was he.

He just happened to be "old" and "a bad driver"... just because this guy's both doesn't mean that all people who are old are bad drivers :)

IMO you should consider yourself lucky he didn't insist on calling the Police, because they'd be looking at charging you for "Driving Without Due Care and Attention".

The leading case on misleading signal is Wadsworth v Gillespie 1974. It was held that primary liability rested with the party pulling out, but the party signalling was held 1/3 contributory negligence, i.e. the case settled on a 2/3rd 1/3rd basis in favour of the party signalling.

There is a more recent case (the name escapes me) which was settled on a 50/50 basis upon the grounds that there was evidence to show that the party signalling was slowing down giving more of an impression that they intended to turn.

the police wouldn't care as no one was hurt sadly, but i agree that you were at fault. sorry.

i do a lot of driving round and round oxford all day for work and see this kind of thing A LOT and to be honest you need to be very aware when driving round. As said although we like to think so indicators are not the be all and end all of a cars direction.

to be safe as a driver on today rather congested roads you need to be super aware of everyone els using that road not just cars, if anything the cyclists/pedastrians are more unpredictable than cars as they can and will change direction virtually instantly.

try and get him to accept you paying for repairs or get ready to sit back and get fisted by insurance i'm affraid.

make sure you keep a record of all calls between you and other party as if it goes to court etc then this may be important.

He's having none of it. I will just wait for the insurance to screw me over now. I got a quote earlier with a claim against & its £240 per month. So proper shafted. All for a new grill for me n bumper on the other car.

I don't think the police would even come out for that, My old car got written off parked outside, by a drunk driver and he pegged it, even then they took half an hour to come out and only came 'cos my neighbour said there was petrol all over the road.

The worst thing is, I booked it in for a service and a remap on Friday, which might only be a service now.:thumbdwn

I'll await the insurance letter through the door in the next few days.

Glad I'm a bit older now. I couldn't/wouldn't ever run a car if my insurance was that much.

Not a good position to be in. I had an accident last year in my previous car (losing 3 years of unprotected no claims) and it's now costing me around a grand to insure the VRS :(

Assuming you can predict the behaviour of other road users is a mistake you won't make again, believe me.

Hope it gets sorted soon, but as said before it looks like it'll be a 50/50 at best. If you try and settle things without the insurance beware...the other driver might start claiming personal injury and you could be looking at more than just the few hundred quid to get his car and your car fixed. :thumbdwn:

Be prepared to do lots of shopping round insurance companies within the next few weeks.

I'm gunna ring him and say if we dont go through insurance I'll pay for his bumper & wheel trim. Cos all in its guna be less than £400 plus what ever extra premium they hit me with.

That could be used as an admission of fault.

I'm sorry but from your picture you will be held to blame to a large extent (regardless of signal) - especially as you say you hit towards his rear which tends to indicate that you were just going too fast/not paying full attention. As you admit, you know that you should never rely on a signal at a giveway - you should wait until it is 100% certain. At roundabouts people frequently signal early/late/incorrectly and you should drive accordingly (sorry for the grandma/eggs thing).

Regardless of the apportion of blame on the claim your insurance will go up. Take it on the chin and go through insurance and at least get something back off the robbing gits.

The accident is declarable claim or not and your premium will go up accordingly anyway.

if the old guy is lecturing you on driving etc and being a ****... tell him that your not ringing him for driving lessons in all due respect. its not his place to say seeing how he cant use an indicator... dont take shizzle from ppl who think they know better...

Well I probably couldn't afford that so I'd sell it if I have to. its £140 atm which is a bit high but liveable.

I will do a lot of searching at the time for renewal though.

140 PM at the moment and 240 with an accident? How old are you? I'm paying (yes in one go but..) £850 and I'm only 22 - 21 at the time I took the policy out. I thought that was dear compared to £500 for a vectra SRI... jeez

As one of the old gits John rs is commenting on there is one thing to look out for in cases like this on roundabouts.

Watch the front wheels, you would have seen that he was going straight on. I use it all the time and it has stopped me making stupid mistakes. You see the wheels move left/right before the body appears to move that way.

Just to pi$$ you off my VRS ins with mods + 1 accident is £285.

If you know of a wittness, then surely it doesnt matter whether they want to get involved or not?

Give the details to the insurance firm. Any CCTV in the area?

You could try E Car they have a panel at the end where you can add mods on and see how much it will cost before you take out the policy. My '54 Octy VRS est. and my 2.7 Porsche Boxster £900. Still rather have my youth back and pay more! Sad old B***** 'aint I!!!
