On the way back from work I hit someone on a round about! Well I was going straight over and the guy was indicating left but actually went straight on. So i hit the old git. I know i shouldn't of assumed he was turning but i did, anyway what do you think the insurance will say. My fault, or his. I have possibly 2 witnesses, a car flashed me over down the street and i pulled over and they said they saw him indicate. I say possibly because they don't want to get involved but he was adamant its my fault and is getting on to his insurance. ASAP.

Might end up as a 50/50 at best I would think but they would possibly conclude that you weren't paying proper attention.

Depends on whereabouts the cars hit.

I would have thought it will be classed as a 50/50.

You fault for pulling out, and his fault for being a pillock. If you got the witnesess details it will be a bonus.

If the damage is only slight, you may be better off stumping up the cost of repairs yourself, so you don't lose your ncb and excess payments.

I had exactly the same scenario some time ago with a Direct line insured driver, I was insured by Elephant at the time.

They offered me a 50:50 and I turned it down and contested it in court (Had legal cover in my insurance). Eventually settled at 85:15 in favour of me.

Well he was all for going insurance, probably because like said i pulled out on him. He was having non of the indicating. It was my word against his, an still is at the minute. I hope i can foot my bill and he his, my excess is £400. i hit his rear wheel/ bumper. didn't look too bad on surface but who knows underneath.

I am with Direct line with added legal protection. Did you have witness's? i possibly could, if i can talk them into a good deed.

you may get 50:50 bt thing to think is at the end of the day if you had been driving slower youd of been able to stop in time (not passing judgement) it may be beneficial to you if you can settle outside insurance company as then you both dont loose your no claims.

if he had hit you it may be different and id say fight it but you hit him as you where unable to stop in time. but this is what i can make from what ive read. sorry to hear though never a good situation to be in.

Any chance of a diagram ? I'm reading this as two cars trying to get into the same lane on a roundabout.... not pulling out of a junction into another car ?

Then again I doubt there will be cars in 40 years so don't worry

I read an article the other day on moneyfool.co.uk - R&D phase 2006-2008 about car insurance liability etc. I am sure they had a test case quoted for just such a case (some one indicating wrongly) and there was certainly a split in the blame (can not remember the actual split). Would be worth chasing up. Always helps to be able to quote a test case or something else legal sounding when talking to insurance company/ or person you hit (they then think you know something about the situation and will not try to fleece you!!).

I was going straight on, he was going straight on from the right, but indicated left. As said above I dont not accept responsibility I know i should have waited etc, I want to go out of insurance but he doesnt. I'm gunna ring him and say if we dont go through insurance I'll pay for his bumper & wheel trim. Cos all in its guna be less than £400 plus what ever extra premium they hit me with.

Your claim of not being to blame would make more sense if he'd hit you in the side of your car, judging from the diagram.

I reckon you're at fault, but you were there not me :)

I think.. and correct me if I'm wrong, but the highway code states the you shouldn't pull out until someone commits to the manouver they are indicating for ?

Tbh, if you've pulled out into the side of him, which judging by your diagram and where the cars made contact is what happened, you're going to struggle to get better than 50/50. His indicating to turn left off the roundabout could effect the split, but if he was in front of you when you hit him then you should have seen him and stopped as he had right of way.

If it goes through the insurance then I'm sure you will get at least partial blame. I had a similar accident a few years ago where another car was indicating to turn but didn't, I pulled out in front of him. I was told by my insurance that indicators should be used as a guide as to where the vehicle MIGHT go, but nothing more. My argument is that people should learn how to use their indicators, but that didn't get me far :P

I think it might be worth speaking to the other party again. I highly doubt that total blame will be given to either party, so you will both end up paying your excess and suffering increased premiums in the future. Perhaps if you get this across to the other driver, he may be more inclined to settle it without the insurance companies. If you do decide to settle without a claim then it's best to inform the insurance companies ASAP. When I retracted my claim I was charged for the time they had spent 'investigating' the situation.

I agree with that, he was in his 60's, real know it all; "you are supposed to give way onround abouts" erm yea but you dont indicate left when going straight on, MATE. He was having none of it. any way I'l ring him later and post the outcome.
