Advice needed quick - My CR VRS is really a PD

I just asked about the price to see if the offer the dealer made was worth anything. You may as well call the price quits then if its only £35. They have offered you £150 but that won't put you back into the position you should be in with a CR engined car - you can't take your Octy and the £150 and expect a dealer to swap it for a same spec/condition Octy. The contract that was broken. But I presume the contract terms wouldn't state what would happen if you were given goods you hadn't asked for, so it would be down to law to sort out.

I wonder what the dealer would have said if the shoe was on the other foot?

when i had my arguements with a skoda dealer i got legal advice and all it took in the end was a well written letter from myself and not a solicitor explaining that i was going to stick to our original contract and will be turning up on a certain day and time to complete and if they had any issues with this then they should speak to my legal advisor. i quickly got a reply saying no problem but could they make it a day or two later and it all happened as planned and saved me around £3500 :)

If He told you that the car you purchased from him is something it is not, surely that could be seen as Fraud.

No expert don't all shoot me down at once.

I think a very well written letter from a solicitor will change there mind. your right not to except his deal

The car dealer in in breach of contract he was asked to supply a CR and provided a PD , the actual price difference is not the issue

I suspect the best solution is to call it quits it you take back your old car and return the Skoda

I would offer them that option and another that they source a CR model with similar mileage to the pd you currently have

If the Car Supermarket was an Estate Agent (which I am) you could raise the complaint through the Ombudsman for Estate Agents (OEA) and he could be in court by now for breach of the Property Misdescription Act 1991. :eek: ;)

Update so far.

Received a letter from the supermarket, now offering me 2 options :-

1. My old car back + the money, less £300 a month usage charge on the skoda (i.e. £3.7K back when I paid £5k.

2. £150 compensation plus £100 goodwill payment.

At the moment, I have stalled any further action and letting them wait for my decision. Been busy at work and all that.

Also emailed Whatcar help line to see what they would recommend. I would really love for them to come back to me wanting to run a story.

Basically I need to decide whether to take the £250 or go to a solicitor and risk a long drawn out case. After all, its going to cost me to proceed with a solicitor..

The supermarket are standing their ground saying all they have to do is return me to the pre-contract state, my old car back, and the monies, less a usage value for 4 month.

The last thing I want is to accept my old car back and end up worse off. After all, I do love the skoda.

I just think they are getting off lightly with £250 compensation

i agree, there getting off lightly. even if they take the skoda back and give you your car back for nothing your still going to be worse off as your old car will be worth even less now,

Personally though, id say i want my old car back and hand the skoda back for nothing, take my bussiness else where and find another good deal

Do solicitors not offer a free initial consultation? I think this is as good as they will offer with out professional intervention. For every month you have it potentially its costing a further £300.

Have they give you a break down on how they come to these outrageous figures. They seem to have plucked them from thin air.

It has been said before, I believe, try your local Citizen's Advice Bureau or a local Solicitor's Law Centre their advice will be FREE.

As to the Car Supermarkets offer; it is derisory and they are trying to play you for a numpty!!!! REJECT IT.

Oh, and for what its worth, if you take dan_the_v8man's advice and swap cars calling it quits on the money side you are the looser surely to god.

Get down the CAB or a solicitors for a half hour free consultation and start proceedings to get the buggers into court. The longer you wait the more amunition you give them, especially if their offers and your complaints have not been in writing and proven to be delivered.

Most solicitors will give you a 30mins free consultation, just make sure that's agreed before you start. And make sure you turn up with all the documents and a short written (printed) summary to save time.

CAB is very good, especially if you get there 30 mins before they open (it's worth it, believe me)

.... at the end of this, I suspect you will need a solicitors letter to make it stick, but you can always insist that part of the deal is that they pay your (reasonable) costs.

I have no doubt they would lose a legal challenge as it is an open and shut case of breach of contract, the argument may well be that they are due a "fair and reasonable amount" for wear and tear, but a solicitor will advise you what this could be.

I can't believe if you are so unhappy with the deal that you haven't taken legal advice immediately. You may be entitled to it from insurers(car and home), Breakdown Cover, Credit Card, Union membership as well as a host of other sources like a visit to a solicitor. If nt careful you'll run out of the option to reject the car. It should be handed back with the keys and a covering letter sent Special delivery.

Maybe these other questions have been asked. Did you pay on finance? Have you contacted CAB or trading standards?

I'd be getting some legal advice, and pronto at that.

Just a thought but as they are trying to charge £300 per month for the usage of the vrs .....haven't they had the use of the part exchanged car for the same amount of time ....that should at least cancel that one out

If you were renting a car or buying a car and decided you didn't like it them maybe, however they made the mistake and as such they have to fix it at no cost to you.

They should actually provide him with a CR or a full refund for the purchase price of the car. IMHO the part ex is a separate deal, but if that came back into it he should be compensated for the loss of value of the car plus usage etc while they have had it.

You need to do something asap with legal advice though.

Am I missing something here or are they now asking for or trying to hold you to payments for using their car which are not laid down in any sort of contract. Where have you signed a contract to say that if they mess up and you use their car you will pay for it ?

I had an issue with a builder last year not adhering to the contract we had agreed (shocking quality and over time scales) so i refused to pay on the basis that I had to have the work done again. He took me to court and in a couple of hours I walked away without paying a penny. He breached the contract we agreed, as simple as that.

Seems to me that there is a similar principle here so I'd get yourself down to a solicitor immediately and tell the garage that all future contact should be directed to Blah Blah & Co solicitors.

Go, do it man. Don't be pushed around by them.

Finally went to a solicitor (they are not cheap at £150 per hour), and have had a response back today.

The supermarket, who I have no problems in naming now that it has gone this far (THE CARPEOPLE in Sheffiled) have offered me my money back' less £300 per month usage charge. In otherwords thay will pay me back £15900-1500, which is £14400 pounds upon the vehicle being inspected by their representative.

Obviously, out of that money, I will have to pay for the solicitors letter and phone calls.

Yes if they agree to pay a usage charge for your car otherwise you lose out there.

How much will it now cost you to buy a CR engined VRS of the same age and mileage as the PD one you currently have?

That's what I'd be looking at to decide if it's worth it or not.

That doesn't sound too different (without going back through all your previous posts) from the offer they had made you directly in the first place. You don't seem to be any further forward.

I will repeat my initial advice; 1. New CR engined car or 2. big fat compensation payment.
