I do know that the legislation changed a few months ago and the company's are allowed to send out a charge notice. 

if you read the Martin Lewis link it tells you how to challenge an UNFAIR parking charge.

Now is it unfair to be charged for staying 45 min over a 2 hour free period, I don't think the company will think so.

Not strictly true about the enforcement. As with many things, here it's particularly dependent on the "small print".

Every last dot needs to be understood before it can be fully answered.

Ignore it used to be the best course of action, but the law has changed quite markedly this year.

There are extra restrictions placed on how the companies are required to act, *but* if they do follow all the rules then they can enforce these penalties and have started to take people to court.

You need to understand the rules and legislation and carefully check the wording on the signs and letter before making any decision.

 

One thing that *is* worth doing is speaking to the store concerned, as quite a few people have had a lot of success getting them to cancel any action, especially if you've made purchases.

This is no longer correct advise, the law has changed in favour of the parking companies and some have taken cases to court and won. If taken to court the fine will be much larger than the current one plus a victim surcharge payment on top.

Either pay it or do your research very carefully. To be honest, painful though it may be, you would probably be better off paying it and putting it behind you. Ugh.

When you bought the parking ticket, you entered into a contract, so it will be hard to argue ignorance.

Someone I know used to argue that they had no record of who was driving the vehicle on the day. I think though that loophole is now closed.

Send a letter back stating that you are not entering into contract with them and that the matter is closed.

They cannot do anything! They get money through scare tactics alone. You dont have to pay a bean

If there are clearly displayed signs, then parking constitutes acceptance. A civil court will rule in the parking company's favour using the balance of probability. If they choose to take the matter to court the OP will face a hefty fine.

If the chap purchased a ticket, then that would also constitute hard evidence of accepting the contract.

Oh and never disclose the driver, appeal as the owner/registered keeper, refer to driver as third person...

Spend some times on those forum you will learn what you need.

Looks like Excel is a BPA approved operator, so there is a proper appeals process. 

 

But you'll need some mitigating circumstances to be successful. Just saying you lost track of the time won't cut it......How long over the 2 hours was the ticket issued?

Mitigating circumstances don't work, have to challenge them of proof of losses, legal right to issue and shoddy signage...everything you need Is on the forums, I'm doing the same over parkway retail park fine

The "modern" approach seems to be that you have to get "in their face" and challenge them to prove contract/loss or whatever.

 

ISTR that all changed around November last year. Assuming you leave it to the point of getting a judgement against you, you now now have revised bailiff rules to party with too.

 

Well worth being proactive about it and fighting tooth and nail.

 

Personally, I find contracted out and CCTV enforcement (e.g. bus lanes near traffic lights) a pedantic ball ache. If enforced sensibly. you'd get ticketed for creating an obstruction or blocking other vehicles. Oh no though, because the companies in question are targeted and paid to ticket, every minor infraction results in blasted ticket.

Some I have responded to and told them that although they have a picture of my car entering and leaving the car park via ANPR cameras at no point do they have a picture of my car static in the car park for any period of time, therefore they cannot actually prove I ever parked in the car park and their cameras are faulty so its void and they would have a pretty hard time enforcing this in a court!!

 

Other ones I have just ignored, and its still worked... fair enough the correct advice may be to challenge them but you only have a certain amount of time to do this and if that lapses you cannot and would have to wait for the court letter etc, also they then have details to keep sending you additional toilet paper to wipe your arse with!!.... its all very well saying they will send bailiffs round but they cannot do this without a court order and a period of time to pay any fine if the court went in their favour (which quite often they wont)

 

Private car parks are much the same as your neighbours driveway, private land, owned by someone, but not enforceable by law!!

 

Its well known that Courts, Judges, any decent member of society dont like these companies so doubtful you will hear of many people actually being taken to court... you should google the video from watchdog on this with a solicitor giving advice on what to do... quite funny!! he makes a paper aeroplane from the notice!!

My old boys actually just received one from an aldi carpark. Apparently you need to register your vehicle in the shop upon entry the receive the free parking.

This was in wales and obviously we are from scotland so it was a one time trip. And who's going to notice that.

What they have is 2 pictures

One upon entry then 40 mins later one upon exit.

How should we play it?

We drove around the carpark but never parked? And something must be up with there times?

Or just ignore it

And by usefull, he of course means that it's full of crackpot nonsense.

"Use at your own risk" because you are likely to fail badly and probably annoy a judge.

Please remember the people offering the advice are tucked safely away behind a keyboard and may be in a different country.

You are completely wrong, the law has changed in the last few months and the companies are now taking people to court and winning. If the OP follows your advise they could end up with a criminal record and a large fine or CCJ.

This is really bad advice. The law has changed.

Advice as per above for any private parking fine.

Read moneysavingexpert and pepipoo. Appeal on actual amount of loss, legal authority to take action, crappy signs and anything else you see on there that fits

They will reject, and give you a popla code , appeal on there on the same grounds and you will be fine.

All done electronically with templates to follow.

Get it right first time and you will be fine, might take an hour of your time but sure its worth £100 to anyone... If not... Send me your address and ill send you an invoice, I could do with the money, haha!

Contact Aldi. If paid for by bank card there will be a record of your transaction.

Gather the evidence. My other half got a ticket in a private car park and told me there were no signs. I went to check and there were 6 foot high bright yellow signs all over the car park. if the signage is not clear then there may be grounds to appeal.

my friend who is a driving instructor was hit with a fine for parking in a car park for 8 hours. As the car park was an anpr car park he was picked up coming in, but then not picked up leaving. He came back 7 hours later on another lesson (to practise parking) and was picked up leaving on that occasion. Successful appeal as the op could not actually prove he has been there the whole time.

Tricky one this, firstly I would say did you see signs telling you this was the case? second, were you advised that you needed to register the car? If you actually went in and purchased something I would be inclined to contact them saying that yes you did park there because you went in to buy something (showing copy of receipt as proof) most car parks like this are free for a few hours anyway so you didnt even out stay the reasonable amount of time allocated free... therefore they would have a hard time justifying to a court why they felt it acceptable to charge you £60 for staying 40 mins in a carpark thats prob free for few hours anyway just because you were unaware you needed to register your car (being from another part of the country you have no knowledge of needing to do this based on it being your only ever visit to the store) 

 

For the record Aldi near where I live you dont need to register, so its clear that these ****** car park companies try all sorts of new tactics to catch people out!!

 

As stated by TDI ben, these ANPR cameras are unreliable, they rely on catching your numberplate almost head on... I have been sent 3 parking fines from the same company who run a motorway services near where I live.. (2 miles from my house and I use it as a cut through to get on motorway) 3 times the camera has got me entering and not leaving, then when i take the same route a day later they say i parked there for 24 hours and owe them 100 quid!! yeah right... every time ive used the same argument that yes, they have a picture of my car entering and leaving a day later, but at no point do they have a picture of me parked in their carpark so go ahead and take me to court as they actually have no proof at all!!! then followed up with (why would I want to use your poxy services when I live less than 2 miles away??) cherry on the cake was I got one for parking there xmas eve, all the way through to xmas day eve... so instead of spending xmas with my daughter eating nice food and having fun, I chose to spend it at their scummy services?? that was the final straw for me so now every time i pass the cameras i wind the window down and flip the bird.. at least the next picture that turns up will be entertaining to see!!
