Not mine, but the wife got nabbed some months back, she opted for the points rather than the awareness course (I know I know !!)

She paid the fine over the phone and forgot to send her licence, she finally got around to sending it after they contacted her. Anyway her licence ended up found at the local sorting office somehow out of the envelope, bit more delay to which she contacted them to explain, the PO ended up sending it on for endorsement.

Nothing other than like I say it dragged on a bit due to her being a bit thick !! It was 34 in a 30 which seemed a bit low to be honest.

 

 

I was really enjoying the fact that she had a ticket too !!!

 

 

I'm thinking someone found a way out of it and they scrubbed a few just in case.

Guy at work had a similar thing go the other way.

The force lost his licence, admitted it, then sent him a court summons.

They didn't stop it going ahead, and then they didn't turn up to court. Naturally thrown out

Has your insurance increased as a result of declaring the points/conviction? Or did she "forget" to declare that too?If it did go up should you be able to get a rebate from the insurance or police?

The 10% plus 2 is just a guideline, it does not have to be followed. Any force in the UK can prosecute you for doing 31 in a 30 should they so chose, nothing is written is statute that says they cannot do you for speeding until you are doing 35 in 30, otherwise everyone would just drive at 34mph all the time.

 

Its a common misconception that the 10%+2 is set in stone, its just an ACPO recommendation and not law.

 

There must have been another technicality, in England a number of speeding cases have been cancelled near where I live because of issues with camera approval/use. On the M25 there were issues with the font of the variable speed signs not being correct which had the same result.

I dont think she got to the stage of putting the points on the licence so probably didnt declare it.

Either way. I wouldnt push my luck with the police. Just consider herself lucky shes got off with it.. Somehow. lol.

Everybody does drive at 34mph most of the time haha

I'd say now't, keep the £100 for your self and keep reminding her she has 3 points. Tell her the points are electronicly stored at the DVLA

I dont think she got to the stage of putting the points on the licence so probably didnt declare it.

That's it. There wouldn't have been any rush after that anyway.

It only took her nine years to let the DVLA know she had moved. The law states six months iirc.

I let her get on with it. That's her problem if ever there's any come back. She was told !!!

As manny says there must have been a technicality or something.

I did tell her last night that I'd had a word with the chief constable. Best part was she actually belived me.

If you do a driver awareness course the police make more money for there budget . If it's a court fine, they will get very little or none. If the lady decided to take it to court she would get off. And the police know this and that's why they dropped the charges, they don't know what to do when a person says no to the driver awareness course.

I think the police are scared of incurring the wrath of Briskoda mod's better halves as there seems to be a pattern emerging here! :peek:
